CITY OF MAPLEWOOD PUBLIC HEARING NOTICE 

What is Being Requested? 

St. Paul Regional Water Services (SPRWS) is proposing to build a 341,000 gallon storage/holding tank for lime sludge at their main campus at 1900 Rice Street. Lime sludge is a by-product waste from their potable water treatment process. The tank is 42 feet in diameter and 33 feet high. The tank is needed to replace an old steel tank that has corroded over the years from holding lime sludge. To construct the new tank, SPRWS requires a revision to their conditional use permit for a public use. 

Public Hearing Information 

The Maplewood Planning Commission will hold a public hearing for this proposal on Tuesday, April 17, 2018, at 7:00 p.m. or later. This meeting will be held at the Maplewood City Hall, 1830 County Road B East in the City Council Chambers. All interested parties may appear at the hearing and present their views orally or submit written comments before the meeting. Sign language interpreters are available. You must request this service at least four days in advance. Call the city clerk at (651) 249-2002 to arrange this service. Assisted Listening Devices are also available. RESOLUTION NO: 2018-022

RESOLUTION ON CHANGES TO THE WASHINGTON COUNTY SOLID WASTE ORDINANCE NO. 200 

Date: March 20, 2018 

WHEREAS, Washington County has committed to protect and ensure the public health, safety, welfare and environment of the county’s residents and businesses through sound management of solid waste generated in the County; and 

WHEREAS, the Minnesota Waste Management Act imposes various mandates upon counties and was created out of concern for the protection of water, air and land resources, as well as protection of public health; and 

WHEREAS, Minnesota Statutes §115A.02 Subd. a(4) establishes a state goal of coordination of solid waste management activities among political subdivisions, and 473.811 Subd 5(b), requires local units of government within the metropolitan area to adopt an ordinance governing the collection of solid waste within its boundaries; and 

WHEREAS, Minnesota Statutes § 115A.93 Subd 2(b) requires county boards, by resolution, to adopt the licensing authority of a city or town that does not issue licenses, and allows counties to delegate authority to a consortium of counties for licensing collection of mixed municipal solid waste; and 

WHEREAS, Minnesota Statutes §473.811 Subd 5a, requires each metropolitan county, by ordinance, to establish and revise rules, regulations, and standards for solid waste facilities within the county; and 

WHEREAS, pursuant to state law Washington County has adopted and received approval from the Minnesota Pollution Control Agency for its Solid Waste Management Master Plan, which acknowledges the county’s role in regulation and planning for waste management, including coordination of solid waste hauler licensing; and 

WHEREAS, in order to discharge the mandates imposed upon counties by state law, including the Minnesota Waste Management Act, Washington County has developed and implemented various solid waste management regulatory programs, including solid waste facilty licensing and inspections, illegal dumping investigation, and a joint Regional Solid Waste Hauler Licensing Program; and 

WHEREAS, Washington County is a member of the Regional Hauler Licensing Joint Powers Agreement, effective January 1, 2017, which replaces the June 8, 1993 Joint Powers Agreement with the Solid Waste Management Coordinating Board, and which requires amendment to the Solid Waste Ordinance to reflect this Agreement and the county has taken this opportunity to make amendments to the Solid Waste Ordinance. 

NOW, THEREFORE BE IT RESOLVED, that the Washington County Board of Commissioners repeal Solid Waste Management Ordinance #200 and replace it with a new Solid Waste Management Ordinance #202, which will become effective immediately.

The following is merely a summary of Washington County Solid Waste Ordinance #202, and the full text of the ordinance is available for public inspection at the Washington County Public Health Department or by electronic mail. 

Purpose, Scope and Authority: This Ordinance establishes standards for the regulation of Solid Waste Management activities and Facilities in Washington County, Minnesota. This Ordinance requires that appropriate licenses be obtained from Washington County for the establishment and operation of Solid Waste Management activities and Facilities. This Ordinance is intended to protect, support and promote the health, welfare and safety of the public pursuant to Minnesota Statutes, Chapter 115A, 145A, 375, 400, and 473. 

Definitions: This Ordinance incorporates by reference terms defined in the Waste Management Act, Minnesota Statute 115A.01 et seq and further defines terms related to solid waste management and regulation. 

Department Rights and Duties: The Department of Public Health and Environment shall have the right and duty to administer this Ordinance. The Department’s rights and duties shall include, but shall not be limited to the following: Conduct inspections to determine compliance with the provisions of this Ordinance, issue licenses for solid waste activities, establish conditions for licenses. The Department shall have further duty to investigate complaints of violations and to recommend, when necessary, to the County Attorney’s Office, that legal proceedings be initiated against a certain Solid Waste Management activity, or Facility. 

Licensee Responsibilities: Licensee Responsibilities for solid waste activities under this Ordinance shall include, but not be limited to compliance with all of the provisions of this Ordinance, and any other applicable Federal, State, or local rule, regulation, or requirement. No Licensee shall operate or allow any Solid Waste Management activity or Facility, Dispose of, or permit to be Disposed, any solid wastes in a manner so as to degrade the soil, air, or waters of the County. 

License Required: Unless otherwise provided by this Ordinance, no Person shall cause, permit or allow real or personal property under their control to be used for Solid Waste Management purposes, except for an operation or activity and location for which a license has been granted by the Department. The procedures for license issuance, denial, variance, revocation, suspension, renewal, administration, and fees shall be governed by the Washington County Administrative Ordinance, to the extent that said procedures do not conflict with provisions of this Ordinance. 

License Conditions: The Department may impose conditions on any approvals or licenses that are issued by the Department that may be necessary due to the characteristics of the waste, Facility specific conditions or other non-typical management characteristics or conditions pertinent to the regulated Solid Waste Management activity or Facility in order to protect public health, safety, or the environment or as otherwise provided by law. 

Financial Assurance/ Insurance: Solid Waste Activities or Facility licenses shall be contingent upon the Licensee providing the Department proof of Financial Assurance as established by the Department. 

Continuation of Expired License: Person who holds an expired license and who has submitted a timely and complete application for reissuance of the license may continue to conduct the licensed Solid Waste Management activity until the Department takes final action on the application provided the Licensee is in compliance with the terms and conditions of the expired license. 

Termination of Operation: A licensee must remove all Solid Waste and accumulated materials, prior to termination of operations. Any Person who owns property on which Solid Waste or other accumulated materials has been abandoned must remove these materials. 

Solid Waste Facility Design, Construction and Operational Requirements: Solid Waste Management Facilities and site shall be designed and constructed in accordance with MPCA Solid Waste Management Rules 7035.2535-7035.2655, incorporated by reference as a part of this Ordinance. Design and Construction Requirements include the following: Litter control, firefighting facilities, vehicle queuing space, communication facilities, controlled access, and an all-weather road. 

General Operating Procedures: Any Solid Waste Facility or Site licensees shall prevent the burning of Solid Waste, the acceptance of radioactive, infectious, hazardous materials, and creation of public nuisance. 

Collection and Transportation of Solid Waste: No Hauler shall collect or transport mixed municipal solid waste (MMSW) Generated in Washington County unless the Hauler has a valid Base License and a Washington County Operating License. To obtain a Base and a Washington County Operating License, the Hauler shall submit a completed application and pay the fees required. Such license applications, fees, and requirements are established by the Regional Hauler Licensing Board. Waste hauler licenses shall be valid for two years and are non-transferable. 

All waste Haulers shall maintain insurance of the following types and amounts: Commercial General Liability/Professional Liability with contractual liability coverage in the amount set forth in Minnesota Statute 466.04 and as amended from time to time. The County, its agents, officers, and employees shall be listed as an additional insured as it relates to these liabilities; Automobile liability coverage in the amount set forth in Minnesota Statute 466.04 and as amended from time to time; and Workers Compensation insurance in statutory amount(s). 

The Department may suspend or revoke any Hauler’s Operating License issued by the County for violation of any of the requirements set forth in this Ordinance. 

Equipment and Operation Requirements: Each vehicle or other conveyance used by a Hauler for the collection or transportation of Solid Waste shall: be easily cleanable, leak-proof, and be covered and identify the business name and telephone number of the Licensee. Solid Waste should not be stored in any collection or transportation vehicle in excess of 48 hours, except in the event of an emergency. The Licensee shall charge residential and commercial customers rates for the collection of MMSW that vary with the volume or weight of the waste collected. The Licensee shall not impose a greater charge on residents who recycle than on residents who do not recycle. 

Solid Waste Facilities: Solid Waste Facilities include, but are not limited to: Waste Processing Facilities, Transfer Stations, Recycling Facilities, Composting facilities and Waste Tire Processing Facilities. 

The design, construction, and operation of all Solid Waste Facilities shall be in accordance with MPCA Solid Waste Management Rules Parts 7035.2525- 7035.2875, which are hereby adopted by reference as part of this Ordinance. 

All Solid Waste Facilities shall be operated in compliance with the following requirements: 

1. Unload and load all Solid Waste inside an enclosed building on a non-permeable surface; 

2. Clean and maintain and remove or properly store all Solid Waste at the end of each day; 

3. No Solid Waste may be delivered to or transported from a Solid Waste Facility unless the transporter and the receiving facility has a valid License, permit, or other approval to do so; 

5. All Solid Waste facilities, regardless of size or category, must be licensed or exempted by the Department and be in compliance with MPCA Solid Waste Management Rules Part 7035; 

6. Employ inspection methods and controls for the types of waste received and procedures for management of prohibited wastes; 

7. Facilities open to the public shall post rates and charges for use; 

Solid Waste Facility Throughput and Capacity: Throughput is the amount of Solid Waste the facility can effectively accept in an operating day. Annual capacity is the total amount of Solid Waste a facility can accept during any license as set by permit. 

Facility Records and Reporting: As a condition of Licensure all Solid Waste facility licensees shall prepare and submit reports in the form and manner prescribed by the Department. Operating records must be maintained for three (3) years. Recycling Facility licensees shall also submit the MPCA annual report for that Facility to the Department within 30 calendar days of submittal to the MPCA. 

Composting Facilities: Composting Facilities are subject to the requirements contained in Minnesota Rules 7035.2836 and sections 7 and 8 of Solid Waste Management Ordinance #202. In addition Yard Waste Composting Facilities may accept only Yard Waste, or similar vegetative waste, in Compostable Bags or in bulk; the Operator or Owner shall prevent the accepted material from undergoing anaerobic decomposition. 

Backyard Compost Sites: Backyard Compost Sites shall be considered exempt from the license requirements of this Ordinance and shall not exceed ten (10) cubic yards in size; and shall not create a public nuisance or any conditions adversely affecting the environment or public health.

prior to licensure, construction and operation of a Construction and Demolition Waste (C&D) Land Disposal Facility: Design of liner system that complies with MN Rules 7035.2815, Subpart 7, subsection A-N, Land Use Plan including intermediate stages, the total area and post closure development land use. 

Waste Tire Collection Sites and Facilities: Waste tire facilities shall: maintain a minimum separating distance of fifty (5) feet between the Waste Tire Collection Site or Processing Facility operations and property line(s); Provide adequate visual screening to reduce visibility of above-grade operations; and be operated to minimize interference with other activities in the area. 

A License shall not be required for the following: Waste tire collection Sites at a retail tire seller, a tire retreading business, a licensed and permitted land Disposal Facility, a Person using waste tires for agricultural purposes if the waste tires are kept on the Site of use. 

Land Application of Wastes License Required: Land application of Solid Waste requires approval from the Department. Sewage Sludge and solid or dissolved materials in domestic sewage are regulated by state rule (Minn. R. Ch. 7041), Minn. Stat., Chapter 115, Washington County Ordinance No. 196, and by Federal Rule (40 CFR Chapter 1, Subchapter O, part 503). Application for Land Application of Solid Waste shall be not less than thirty (30) days prior to initiation of proposed Land Application activities. Annual documentation of the amount, location(s) and type(s) of waste land applied is required. 

Illegal Dumping: No Person shall Dispose of Solid Waste within Washington County at any place except at a Site or Facility authorized by this Ordinance. 

Solid Waste Designation: All Acceptable Waste Generated within the County must be delivered to the Designated Facility and may not be delivered to any other Solid Waste Facility. The County may from time to time designate additional Solid Waste Facilities. This provision is binding on all Persons in the County, including without limitation, political subdivisions, Solid Waste Disposal Facilities, Generators, Haulers, and Self-Haulers. 

Waste that is delivered to the Designated Facility pursuant to waste delivery agreements between Haulers or authorized Self-Haulers and the R&E Board, is exempted from the requirement of Solid Waste Designation for the term of such agreements. 

Acceptable and Unacceptable Waste: The Designated Facility must accept all Acceptable Waste delivered to the Designated Facility, unless the County has declared an interruption of Designation. All deliveries to the Designated Facility shall be in accordance with this Ordinance and procedures of the R&E Board. No Person may deposit Unacceptable Waste at the Designated Facility. Unacceptable Waste shall not be mixed with Acceptable Waste. The Designated Facility may reject Unacceptable Waste. 

Interruption of Designation Requirement: The Director of the Department may interrupt the Designation requirement and will provide reasonable notice of any interruption to Haulers, municipalities, Self-Haulers, and Solid Waste Disposal Facility Operators. 

Exempted Waste: The following types of waste that are exempt from waste designation requirements: materials that are separated from mixed municipal solid waste by the generator and recovered for reuse; recyclable materials; materials that are processed at a resource recovery facility at the capacity in operation at the time that the Joint Waste Designation Plan was approved; and materials that are separated at a transfer station that has a license and is located within Washington County for the purposes of recycling the materials, provided that the transfer station was in operation on January 1, 1991 or the materials were not being separated for recycling at the R&E Center at the time the transfer station began separation of the materials, materials excluded pursuant to Minn. Stat. § 115A.84, Subd. 4, Subject to approval by the Commissioner of the MPCA; Recyclable Materials that the County determines will be separated for Recycling at a Transfer Station located outside of the County provided the Transfer Station has not been found in violation of the Designation provision and separated materials are actually recycled; and the Owner or Operator of the Transfer Station or other Solid Waste Facility reports to the R&E Board the quantities of materials to the R&E Board. To qualify for an exemption Transfer Station or other Solid Waste Facility owners must receive written approval from the County. Any Person aggrieved by the decision of the County may appeal to the Commissioner of the MPCA. 

Recordkeeping and Inspection: All Self-Haulers, Haulers, and Owners or Operators of Solid Waste Facilities must comply with the recordkeeping and inspection requirements of Minn. Stat. § 115A.882, as amended. 

Solid Waste Disposal Prohibition: No Person may place, or transport for placement, Solid Waste that is Generated in the County in a portion of a Disposal Facility that does not comply with the minimum requirements for design, construction, and operation of a Disposal Facility Pursuant to Minnesota Statute § 473.849, effective January 1, 1992, for Disposal Facilities located outside the metropolitan area and January 1, 1995, for all Disposal Facilities regardless of location 

Enforcement: All provisions of this Ordinance relating to licensing and licensed Solid Waste Management activities, Sites, or Facilities shall be enforced pursuant to the Washington County Administrative Ordinance #149, or any or all of the remedies available under this Ordinance. 

Additional Requirements and Provisions: Due to the great variability in the types of Solid Wastes and their existing and potential management methods, the Department may waive or modify the strict application of the provisions of this Ordinance. 

Where the conditions imposed by any provision of this Ordinance are either more restrictive or less restrictive than comparable conditions imposed by any other provisions of this Ordinance, or any other applicable law, Ordinance, rule, and regulation, the provision which establishes the higher standards for the promotion and protection of the public health, safety, and welfare shall prevail. 

Construction, Consent, Severability: This Ordinance shall not be construed to hold the Department or the County or any officer or employee responsible thereof for any damage to Persons or property by reason of the inspection or re-inspection authorized herein provided, or by reason of the approval or disapproval of equipment or licensing herein, nor for any; action in connection with the inspection or control of Solid Waste or in connection with any other official duties. If any provision of this Ordinance or the application thereof to any Person or circumstance is held invalid, said invalidity does not affect other provisions or applications of the Ordinance which can be given effect without the invalid provision or application, and for this purpose the provisions of the Ordinance are severable 

Consent: Nothing contained in this Ordinance shall be deemed to be a consent, license, or permit to locate, construct, operate, or maintain any Solid Waste Facility, or to carry on any activity. 

Repeal and Enactment: The enactment of this Ordinance repeals and replaces Washington County Solid Waste Management Ordinance No. 200 adopted September 12, 2017. 

Effective Date: This Ordinance shall be effective immediately after passage by the County Board and publication according to law, provided however, that Section 18 was effective on January 1, 2018.

WHEREAS, the North St. Paul-Maplewood-Oakdale Independent School District 622 provides an opportunity for all of its citizens to participate in district program communities, and 

WHEREAS, the Indian Education Parent Committee of the North St. Paul-Maplewood-Oakdale Independent School District 622 is the established Parent Committee comprised of community members, parents, student representatives and district staff, and 

WHEREAS, the Indian Education Parent Committee’s current responsibilities are to include involvement in the advisement of cultural programs specifically designed for American Indian learners implemented through Community Education and the Department of Teaching and Learning, and 

WHEREAS, the Indian Education Parent Committee of the North St. Paul-Maplewood-Oakdale Independent School District 622 did meet on February 7, 2018 to review, recommend, and approve this Resolution and 

WHEREAS, The Indian Education Parent Committee has found that while progress has been made the District’s educational programs continue to be inadequate in meeting the needs of American Indian students. Those areas of concern are focused on culture and academic needs in social studies, mathematics, literacy and science, and 

WHEREAS, the Indian Education Parent Committee recommends taking the following steps to meet the needs of the District’s American Indian students: 

Step 1. (A) Curriculum in the areas of social studies/history, literacy, science, art and music will be reviewed within the normal review cycle in consultation with the Districts’ American Indian Education Liaison in order to ensure culturally appropriate and relevant materials for students and 

(B) This is to include a monitoring system to make sure teachers are using existing on-line Ojibwe/Dakota curriculum and Learning Trunks to help meet the Minnesota State Standards and 

(C) Indian Education staff to work with Curriculum Coordinator/ Administration to provide teacher-in-services and support for classroom teachers. 

Step 2. (A) American Indian students will be offered specific academic support in all curriculum areas, especially mathematics and literacy. Specific academic support could mean with the teacher before/after school or peer tutors or tutors.

(B)American Indian students are not always easily identified. Indian Education Advisors will make sure all teachers have a list of identified American Indian students that are in their classroom with program contact information. 

Step 3. Even with existing protocol some parents do not receive timely information about appropriate and early classroom interventions to help American Indian students that need academic support. Not all parents have the technology or skills to access the Parent Portal. Indian Education Academic Advisors acting as home/school liaisons need to be included in MTSS, IEP, Check & Connect and other meetings/conversations concerning American Indian students. 

Step 4. The development of Academic Programing for students making the transition between the 5-6th grades and the 8-9th grades. This programing should focus on teaching the skills and habits necessary for success at the higher level of academics the student is moving into. 

Step 5. Too many students enter and continue through high school without the academic skills and work habits necessary to actually earn credits and make progress towards graduation. We support the full implementation of MTSS (Multi-tiered System of Support) in all middle/high schools. 

WHEREAS, District data will be regularly shared with the Indian Education Parent Committee to measure progress in the academic performance of American Indian students, and 

WHEREAS, the LEA Representative will present an annual report to the School Board in order to improve communication and educate members of the Board on issues that are relevant to the American Indian community, and 

WHEREAS, efforts have begun to address these areas of concern, efforts need to continue with full support in order to foster academic success for American Indian students. 

THEREFORE BE IT RESOVED, the Indian Education Parent Committee of North St. Paul-MaplewoodOakdale Independent School District 622 does not concur that the District’s programs meet American Indian student’s needs. 

THEREFORE BE IT RESOLVED, the Indian Education Parent Committee of North St. PaulMaplewood-Oakdale Independent School District 622 concurs that the above steps need to be taken in order to improve District efforts to meet American Indian students’ needs-and that the efforts that have begun to address these areas continue in order to foster academic success for American Indian students.

BE IT RESOLVED by the School Board of Independent School District No. 622 that the 2017-2018 School Calendar be revised to reflect April 3, 2018 as a school day for tenth and eleventh graders only at the high school level with an early release for the purpose of MCA and ACT testing.
