The Ramsey County Board of Commissioners has prepared an Auction List, dated March 20, 2018, attached as Exhibit “B” and on file with the Chief Clerk, of lands forfeited to the state pursuant to Minnesota Statutes Chapter 281, and classified as non-conservation lands pursuant to Minnesota Statutes Chapter 282, and has determined the appraised value of each parcel. 

Notice is hereby given that Ramsey County shall sell to the highest bidder, but for not less than the appraised value as it appears on the Auction List (Exhibit “B”), the parcels of land described on the Auction List, which have forfeited to the State of Minnesota for the non-payment of real estate taxes and which have been classified and appraised as provided by law. This sale will be governed by the terms set out below as approved by the resolution of the Ramsey County Board of Commissioners, adopted on the 24th day of April, 2018. 

The sale shall commence at 10:00 a.m. on May 18, 2018, and will be held at the Ramsey County Plato Building, 90 W. Plato Blvd., St. Paul, MN, in the Plato Conference Center. Any parcel for which “no bid” is received at the public auction sale may be sold the next business day beginning at 8:00 a.m. at the Tax Forfeited Lands Office located at 90 W. Plato Blvd., St. Paul, MN, to anyone offering to pay the appraised value as it appears on the Auction List (Exhibit “B”) and each parcel will be sold on a first-come-first-served basis. Terms and Conditions of Sale 

REGISTRATION/EARNEST MONEY: 

Certified Funds, as Earnest Money, which are equal to the Terms listed below, are required in order to bid on any parcel and shall be required at the time of Registration. Power of Attorney Procedure: Any individual buying property from the Tax Forfeited Land section for another individual or group of individuals will not be allowed to sign the required documents unless proof of power of attorney is provided. 

Required Signatures: 

• Individuals: If the property is purchased in more than one name, all parties must be present at the time of sale to sign all documents. 

• Corporations: If the property is purchased in the name of a corporation an officer of the corporation must be present to sign. Proof of signatory authority will be required. 

Failure to follow any of the terms or conditions stated could result in a void of the sale and the parcel re-offered for auction. No exceptions will be made. 

INTEREST: 

Interest is charged and becomes due with the monthly payment. The rate of interest, as prescribed by Minnesota Statutes, section 279.03, subd. 1a, is charged at the adjusted prime rate, but will not be less than 10% or more than 14%. 

PREPAYMENTS: 

All contracts allow for prepayment of an installment without penalty. Any prepayment is applied first to interest due, if any, and then to principal. However, if the additional payment is greater than or equal to one monthly installment, we will treat the payment as a reduction in the principal. Please provide instructions with your payment if you prefer the payment be treated as an early payment which will delay your next payment due date as appropriate. There is no penalty for paying the contract in full earlier than stated. 

EXTRA FEES AND COSTS: In addition to the purchase price of the property, the following extra fees and costs are due when applicable: 

At the time of sale the following fees will be added: 

Assurance fee: 3% of the total sale price. This is a surcharge for the state assurance account. 

Contract recording fee: $46.00 if abstract or Torrens; $92.00 if it is both. 

• If the contract has to be recorded on more than one Torrens certificate there is an additional cost of $20.00 per certificate after the initial recording. 

At the time of final payment the following fees will be added: 

State deed fee: $25.00.

State deed tax: 

1) A $1.70 for the purchase of properties up to $500.

PROHIBITED PURCHASERS OR BIDDERS: **New Terms 

None of the following individuals (either personally or as an agent or attorney for any other person) may bid on and purchase a parcel of tax-forfeited land unless the parcel was owned by the individual before forfeiture: county auditor, county treasurer, county attorney, court administrator of the district court, assessor or supervisor of assessments, land commissioner or assistant land commissioner for tax-forfeited lands, or any deputies or employees of any of the above individuals. A person prohibited from purchasing property under this section must not directly or indirectly have another person purchase it on their behalf for their own benefit or gain. 

Prohibited purchasers or bidders also include any person or entity, or entity controlled by such person, that (1) is an owner or taxpayer of real property situated in Ramsey County that has delinquent property taxes, or (2) **currently has a contract for purchase of tax forfeited lands for a structure that does not meet the requirements of a code compliance inspection report or home inspection report issued within the past year and has not filed a certificate of code compliance with the Tax Forfeited Lands section or successfully finalized and closed-out all permits through the city in which the parcel is located; or (3) currently has a contract for purchase of tax-forfeited lands in default for any one of the following reasons or combination of reasons: 

• Failure to pay a payment including interest when due; 

• Failure to pay property taxes before they become delinquent; 

• Failure to insure a property containing a structure during the term of the contract; 

• Failure to provide a certificate of code compliance for a substandard structure, as required by the city in which the property is located within the required timeframe; 

• Failure to provide a current certificate of occupancy, prior to tenancy, if the property is used as rental property. 

• Allowing a lien to attach to the property. 

After a winning bid, but prior to closing, a search will be performed to determine if the winning bidder is a prohibited purchaser or bidder, and closing of the sale will not take place until the search verifies the winning bidder is not a prohibited purchaser or bidder. In the event a successful bidder does not complete the closing, or in the event that a winning bid has been awarded to a prohibited bidder or purchaser, the person or entity will forfeit their earnest money, and the sale will be nullified as invalid. The property may be re-offered at a future auction at the sole discretion of Ramsey County. 

FURNISHING OF LABOR OR MATERIALS: 

Buyer shall not, during the terms of any contract, cause any material to be delivered or labor to be performed without written notice to Ramsey County and lien waivers obtained. Buyer further agrees to indemnify and hold harmless Ramsey County against all claims for labor and materials or services made against the property covered by any contract and for the cost of enforcing this indemnification including reasonable attorney’s fees. The purchaser will indemnify Ramsey County and/or the State of Minnesota for environmental contamination as a result of purchaser’s use and occupancy of the property. 

NEW LIENS PROHIBITED: 

Purchaser shall not create or permit to accrue liens against the property. Any action that results in a lien being attached to the property will constitute a default and shall result in cancellation of the Contract for Purchase of Forfeited Lands contract. 

TAXES: 

Tax forfeited property that is sold at a public or private sale on or before December 31st of an assessment year shall be placed on the assessment rolls for that year’s assessment. [Minnesota Statutes, section 272.02, subd. 38(c)] For example, property sold in 2018 will be assessed as of January 2, 2018 and taxes will be payable in 2019. 

ASSESSMENTS: 

Assessments at the time of forfeiture and after forfeiture have been listed and may be subject to re-assessment by each respective municipality. Any Pending Assessments not certified to the State at the time of sale could be passed on to the new owner. 

TITLE: 

Once the contract is finalized and recorded in the County Recorder’s Office the purchaser will receive the original contract. When the contract is paid in full, and all the terms and conditions set forth in that contract have been satisfied, the purchaser will receive a deed from the State of Minnesota through the Department of Property Tax, Records and Election Services. The law provides that this conveyance shall have the force and effect of a patent from the state. The forfeiture does create a break in the chain of title, which must be corrected to secure a marketable title. As other flaws may exist in the title, services of an attorney may be necessary to make the title marketable. 

LIENS PRIOR TO FORFEITURE: 

Most mortgages and liens, except Federal and State tax liens, are canceled at forfeiture. It is the responsibility of each potential bidder to thoroughly research this information. 

INSURANCE: 

The purchaser shall carry fire and windstorm insurance on any buildings on the property in an amount equal to the Purchase Price or appraised value, whichever is greater, for the duration of the sale contract. All such insurance policies shall be deposited with the Tax Forfeited Lands Section of the Department of Property Tax, Records and Election Services, within sixty (60) days from the Execution Date, and shall contain a clause providing that losses, if any, be made payable to Ramsey County, as additional insured, and to the Purchaser, as their respective interests may appear. 

DEFAULT: 

Contracts may be canceled if the purchaser defaults for any one of the following reasons or combination of reasons: 

• Failure to pay a payment including interest when due; 

• Failure to pay property taxes before they become delinquent; 

• Failure to insure a property containing a structure during the term of the contract; 

• Failure to provide a certificate of code compliance for a substandard structure, as required by the city in which the property is located, within the required timeframe;

If a structure exists on a tax forfeited parcel offered at auction that does not meet the requirements of a code compliance inspection report or home inspection report issued within the past year, then within twelve (12) months of the date of purchase the purchaser, as a condition of a sale on contract, shall file with the Tax Forfeited Lands section of Ramsey County a certificate of code compliance, as required by the city in which the parcel is located. Purchaser must show proof of compliance or the purchaser will be in default of the sale contract. An extension of time may be granted by the County Auditor if the City, in which the structure is located, grants additional time to the Purchaser in order to complete the project. 

HOME INSPECTION REPORT REQUIREMENTS: 

Correction of the defects described in a Home Inspection Report will require, at a minimum, a building, plumbing, electric, HVAC or warm air ventilation permit, as indicated. All comments describing a visible or assumed deficiency within the report must be addressed within the scope of repair. The structure cannot be occupied or sold until all permits have been finalized and closed-out through the city in which the parcel is located. If the structure is intended to be used as rental property, you must provide this office with a current certificate of occupancy, prior to tenancy, pursuant to the municipal code of the city in which the parcel is located. Failure of the purchaser to comply with the above terms will be a default of the sale contract.

NOTICE OF ASSESSMENT HEARING 

NOTICE IS HEREBY GIVEN that the City Council of Maplewood, Minnesota, will meet in the council chambers of the Maplewood Municipal Building, 1830 County Road B East, Maplewood, Minnesota at 7:00 p.m. on Monday, May 14, 2018 to hear all persons concerning the adoption of the assessment roll for Public Improvement Project 17-19, Londin-Highpoint Area Street Improvements and to adopt the assessment roll as presented or amended. This hearing is scheduled pursuant to Minnesota Statutes Chapter 429. The assessment roll as herein described is on file in the office of the city clerk. Questions regarding the assessment roll may be addressed to the office of the city engineer. The total amount to be assessed is $468,858.45. 

The general nature of the proposed improvements include a full depth pavement reclamation of neighborhood streets, milling of Londin Lane, new pavement installation, spot curb replacement, and spot utility repairs. This project includes those properties abutting: 

Crestview Drive from Londin Lane to Mailand Road, Highpoint Curve from Crestview Drive to Mailand Road, King Avenue from Crestview Drive to Highpoint Curve, Londin Lane from McKnight Road to Lower Afton Road, Marnie Street from King Avenue to Pond Avenue, Pond Avenue from Crestview Drive to Marnie Street 

Persons who wish to be heard or to object with reference to this matter may present their cases at this hearing, either orally or in writing. No appeal may be taken as to the amount of any assessment adopted unless a written objection signed by the property owner is filed with the city clerk prior to the assessment hearing or presented to the presiding officer at the hearing. 

An owner may appeal an assessment to district court pursuant to M.A. Section 429.081 by serving notice of the appeal upon the mayor or city clerk of the City of Maplewood within thirty (30) days after the adoption of the assessment and by filing such notice with the district court within ten (10) days after service upon the mayor and city clerk. 

Under provisions of Minnesota Statutes Section 435.193 to 435.195 the city may, at its discretion, defer the payment of assessments for homestead property owned by a person not less than 65 years of age or homestead properties for persons retired by virtue of a certified permanent and total disability for whom it would be a hardship to make the payments. The council may also defer any homestead underdeveloped or undeveloped properties for which it would be a financial hardship to pay the assessment. The procedures for applying for such deferment are available from the office of the city engineer. 

The following information shall also apply: 

1. The property owner shall have the right to prepay the entire assessment. Your assessment, or any portion thereof, may be paid without interest from May 15, 2018 through June 13, 2018 to the City of Maplewood at the Department of Public Works, 1902 County Road B East, Maplewood, Minnesota. 

2. Partial prepayment of the assessment has been authorized by ordinance. Partial payment, if made, should be a minimum of 25% of the levied assessment amount. 

3. The rate of interest to be accrued, if the assessment is not prepaid within the required time period, is proposed to be 5.0% (final interest rate determined at time of bond sale) commencing on the date of adoption by the city council and running for 8 calendar years for commercial properties and 15 calendar years for residential properties. 

4. The amount to be specially assessed against your property is shown on the attached public improvement Statement of Assessment. 

This is an important hearing because this is your last opportunity to be heard on the matter of this assessment, which affects your property. If you have any questions regarding this assessment, please call the Engineering Department at 651-249-2400.

OLD VILLAGE PHASE 4 STREET AND UTILITY IMPROVEMENTS 

Notice is hereby given that the City Council of Lake Elmo will meet in the council chambers of the city hall at or approximately after 7:00 P.M. on Tuesday, May 15, 2018, to consider the making of the following improvements, pursuant to Minnesota Statutes, Sections 429.011 to 429.111; 

The improvements consist of the extension of sanitary sewer along 32nd Street North, east of Lake Elmo Avenue, and along 36th Street North and Layton Avenue North, including the reconstruction of the existing streets with concrete curb and gutter, installation of storm sewer, replacement of existing watermain, construction of an off-road bituminous trail along 36th Street North and Layton Avenue North, and park improvements in Lions Park. 

Sanitary sewer assessments are proposed for those properties that abut the improvements and receive a service stub as part of the project including 3235 and 3263 Lake Elmo Avenue North; 11223, 11240, 11247, 11258, 11267, 11279, 11284, 11295, 11306, and 11328 32nd Street North; 3604, 3624, 3646, 3664, 3686, and 3712 Layton Avenue North; and 11299 and 11325 Stillwater Boulevard North. The area proposed to be assessed for the street and drainage improvements include the properties directly abutting and accessing the proposed streets along 32nd Street North east of Lake Elmo Avenue North, along 36th Street North east of Laverne Avenue North, and along Layton Avenue North between 36th Street North and Stillwater Boulevard North. 

The estimated total cost for the project is $2,152,000 with the street and drainage improvements estimated at $1,086,000, the sanitary sewer improvements estimated at $460,000, the water system improvements at $374,000, and the trail and park improvements at $232,000. OLD VILLAGE PHASE 4 STREET AND UTILITY IMPROVEMENTS 

Notice is hereby given that the City Council of Lake Elmo will meet in the Council Chambers of the City Hall at or approximately after 7:00 P.M. on Tuesday, May 15, 2018, to consider, and possibly adopt, the proposed assessment against abutting property for the Old Village Phase 4 Street and Utility Improvements. Adoption by the Council of the proposed assessment may occur at the hearing. The following describes the area proposed to be assessed: 

• Street and drainage improvements along 32nd Street North east of Lake Elmo Avenue North, 36th Street North east of Laverne Avenue North, and Layton Avenue North between 36th Street North and Stillwater Boulevard North. 

• Sanitary sewer improvements along 32nd Street east of Lake Elmo Avenue North, 36th Street North east of Laverne Avenue North, and Layton Avenue North between 36th Street North and Stillwater Boulevard North. Properties include 3235 and 3263 Lake Elmo Avenue North; 11223, 11240, 11247, 11258, 11267, 11279, 11284, 11295, 11306, and 11328 32nd Street North; 3604, 3624, 3646, 3664, 3686, and 3712 Layton Avenue North; and 11299 and 11325 Stillwater Boulevard North. 

You may at any time prior to certification of the assessment to the county auditor on November 15, 2018, pay the entire assessment on such property to the City Clerk with interest accrued to the date of payment. No interest shall be charged if the entire assessment is paid to the City Clerk prior to June 15, 2018. You may at any time thereafter, pay to the City Clerk the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made. Such payment must be made before October 31 (date assessment certified to County Auditor) or interest will be charged through December 31 of the succeeding year. If you decide not to prepay the assessment before the date given above the rate of interest that will apply is 4.50 percent per year. 

Once assessments are certified to the County, the assessments are payable in equal annual installments extending over a period of 15 years for street and drainage improvements and 20 years for sanitary sewer improvements, the first of the installments to be payable on or before the first Monday in January 2019 and will bear interest at the rate of 4.50 percent per annum from the date of adoption of the assessment resolution. To the first installment shall be added interest on the entire assessment from the date of the assessment resolution until December 31, 2018. To each subsequent installment when due shall be added interest for one year on all unpaid installments. 

The proposed assessment roll is on file for public inspection at the City Clerk’s office. The total amount of the proposed street improvement assessment is $411,820. The total amount of the proposed sanitary sewer improvement assessment is $359,600. The City contribution for the overall improvement project is $1,380,580. Written or oral objections will be considered at the meeting. No appeal may be taken as to the amount of an assessment unless a written objection signed by the affected property owner is filed with the municipal clerk prior to the assessment hearing or presented to the presiding officer at the hearing. The Council may upon such notice consider any objection to the amount of a proposed individual assessment at an adjourned meeting upon such further notice to the affected property owners as it deems advisable. 

An owner may appeal an assessment to district court pursuant to Minnesota Statutes, Section 429.081 by serving notice of the appeal upon the Mayor or Clerk within 30 days after the adoption of the assessment and filing such notice with the district court within ten days after service upon the Mayor or Clerk. 

The City Council is authorized in its discretion to defer the payment of an assessment for any homestead property owned by a person for whom it would be a hardship to make payment if the owner is 65 years of age or older and/or the owner is a person retired by virtue of a permanent and total disability or by a person who is a member of the Minnesota National Guard or other military reserves who is ordered into active military service, as defined in section 190.05 subdivision 5b or 5c, as stated in the person’s military orders, for whom it would be a hardship to make the payments. The owner must request a deferment of the assessment at or before the public hearing at which the assessment is adopted and make application on forms prescribed by the City Clerk within 30 days after the adoption. 

Notwithstanding the standards and guidelines established by the City for determining a hardship, a deferment of an assessment may be obtained pursuant to Minnesota Statutes Section 435.193.

AN ORDINANCE AMENDING THE LAKE ELMO CITY CODE OF ORDINANCES PERTAINING TO 

STREET NAMING 

SECTION 1. The City Council of the City of Lake Elmo hereby amends Title XV: Land Usage; Chapter153: Subdivision Regulations; Section 07: Preliminary Plat; Subd. (E) (1) to read the following: 

(1) Layout of proposed streets showing right-of-way widths, center line grade, typical cross-sections, and proposed names of streets in conformance with all applicable city ordinances and policies; the name of any street used in the city or its environs shall not be used unless the proposed street is the logical extension of an already named street, in which event the same name shall be used. The names and number shall comply with the County Uniform Street Naming and Property Numbering System, with the following exceptions: 

a. The names of deflecting streets shall not vary; names of continual streets shall not change, even if the street changes direction, unless an intersection exists. 

i. The names of deflecting streets shall be determined according to their relation to an Arterial or Collector Street if appropriate, otherwise such names shall be determined according to their main point of entry in to a development or as deemed appropriate by Council. 

b. All street names shall end with the directional suffix of North. 

SECTION 2. Effective Date. This ordinance shall become effective immediately upon adoption and publication in the official newspaper of the City of Lake Elmo. 

SECTION 3. Adoption Date. This Ordinance 08-208 was adopted on this 17th day of April, 2018, by a vote of 3 Ayes and 2 Nays.
