NOTICE OF ASSESSMENT LIEN FORECLOSURE SALE 

YOU ARE NOTIFIED THAT, 

1. Default has occurred in the conditions of the Common Interest Community Number 215 (Condominium) Oakcrest Village Condominiums Declaration, Washington County, Minnesota, by Laina Wright n/k/a Laina Kristin Carlson, as fee owner of the below-described property subject to said Declarations. 

2. Pursuant to the Common Interest Community Number 215 (Condominium) Oakcrest Village Condominiums Declaration, filed in the County Recorder for Washington County on April 14, 2004 as Document No. 3434962, and all amendments thereto, and Minnesota Statutes, a statutory lien exists for unpaid assessments and fees incurred from January 1, 2017 to the date of this notice. 

3. No action or proceeding has been instituted at law to recover the debt secured by the statutory lien or any part thereof, or if an action has been instituted it has been dismissed or discharged prior to the commencement of these proceedings. 

4. The holder of the lien has complied with all conditions precedent to acceleration of the debt secured by the assessment lien and foreclosure of said lien, and all notice and other requirements of applicable statutes. 

5. As of the date of this notice the amount due, after acceleration pursuant to the Association’s Declarations and By-laws, is $8,112.66. 

6. As of the date of this notice, the names of all parties that have been released from liability for the assessment lien are as follows: NONE. 

7. Pursuant to the provisions of the Common Interest Community Number 215 (Condominium) Oakcrest Village Condominiums Declaration, the lien will be foreclosed and the land located at 7525 12th Street North, Oakdale, Minnesota 55128, in the County of Washington, State of Minnesota, legally described as follows: 

Unit 115, Common Interest Community 215, Oakcrest Village Condominium, 

will be sold by the sheriff of said county at public auction on August 30, 2018, at 10:00 a.m., at the Washington County Sheriff’s Office, 15015 62nd Street North, Stillwater, Minnesota 55082 in said county and state, to pay the debt then secured by said lien, including any additional assessments and late fees that may become due through the date of sale, along with the costs, attorneys fees and disbursements allowed by law. 

8. The time allowed by law for redemption by the mortgagors, or mortgagor’s personal representatives or assigns is six (6) months after the date of said sale. 

9. RESOLUTION AUTHORIZING PUBLICATION OF ORDINANCE 08-219 

WHEREAS, the City Council of the City of Lake Elmo has adopted Ordinance No. 08-219, an ordinance amending the City’s Zoning Use Types and Classification as it specifically relates to Accessory Uses; 

WHEREAS, the ordinance is lengthy; and 

WHEREAS, Minnesota Statutes, section 412.191, subd. 4, allows publication by title and summary in the case of lengthy ordinances or those containing charts or maps; and 

WHEREAS, the City Council believes that the following summary would clearly inform the public of the intent and effect of the ordinance. 

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lake Elmo, that the City Clerk shall cause the following summary of Ordinance No. 08-219 to be published in the official newspaper in lieu of the entire ordinance:

Public Notice 

The City Council of the City of Lake Elmo has adopted Ordinance No. 08-219, which adds language within the City’s Accessory Use section of Zoning use types and classifications as it relates to Home Occupations. The amended language was intended to clarify the expectations of home occupations. The following is a summary of the adopted language. 

- A certificate of zoning compliance is no longer needed for home businesses/occupation. 

- The code provides examples of what is acceptable as a home occupation, such as a home office. As well as other examples that would not be considered as acceptable as a home occupation, such as a restaurant or tourist home. 

- The City has also established operation requirements which lists out what is acceptable for hours of operation, number of employees allowed, and states that the operation shall not conflict with the nuisance section (Ch. 96) of the City code. 

- Site requirements are also listed, which prohibits property owners from making modifications to the home which would no longer make the dwelling usable as a residence or give off the appearance of a commercial use. 

The full text of Ordinance No. 08-219 is available for inspection at Lake Elmo city hall during regular business hours. 

BE IT FURTHER RESOLVED by the City Council of the City of Lake Elmo that the City Administrator keep a copy of the ordinance at City Hall for public inspection and that a full copy of the ordinance be placed in a public location within the City.

Community Services 

- Approval to authorize payment of $53,355 to Minnesota Housing Finance Agency for the Family Homeless Prevention Assistance Program (FHPAP) grant. 

General Administration 

Approval of the following actions: 

- July 10, 2018, County Board meeting minutes. 

- Resolution No. 2018-080, 2018 2nd quarter donations. 

- Molly O’Rourke, County Administrator, announced that County Attorney Pete Orput has been selected to serve on the board for the National District Attorney’s Association. 

- Board workshop to review the county’s 2018 Energy Plan. 

- Board correspondence was received and placed on file. 

Human Resources 

- Board workshop for an update on health insurance utilization and on-site clinic. 

Property Records and Taxpayer Services 

Approval of the following actions: 

- Plat of Miller Farms 6th addition. 

- State of Minnesota Joint Powers Agreements for election recount services for the recount of votes for the 2018 Primary and General elections. 

Public Works 

Approval of the following actions: 

- Resolution No. 2018-075, participate in the Minnesota Department of Natural Resources Snowmobile Trails Assistance Program and administer grant for the Star Trail Association. 

- Resolution No. 2018-076, Minnesota Ski Trail Assistance Program grant. 

- Resolution No. 2018-077, transfer permanent right-of-way from Washington County to the City of Forest Lake. 

Sheriff’s Office 

Approval of the following actions: 

- Resolution No. 2018-078, donation in the amount of $2,349 from the SafeKids Coalition for a Life Jacket Loaner Station at Lake Elmo Park Reserve. 

- Resolution No. 2018-079, donation in the amount of $1,000 from the Washington County Mounted Posse for the Mounted Patrol Unit.
