WHEREAS, default has been made in the terms and conditions of the Declaration of Common Interest Community, Mistwood Courthome, C.I.C. Number 124, (henceforth the Declaration) dated September 2, 1994 and recorded in the Office of the County Recorder in and for Dakota County, Minnesota on October 24, 1994 as Document 1247241 encumbering the following described property situated in the County of Dakota and State of Minnesota, to-wit:

2019 IMPROVEMENT PROGRAM 

TO WHOM IT MAY CONCERN: 

Notice is hereby given that the City Council of Inver Grove Heights will meet in the City Council Chambers at 8150 Barbara Avenue, Inver Grove Heights, MN at 7:00 p.m. on Monday, 

September 10, 2018 to hold a public hearing to consider the making of the following improvements in the 2019 Improvement Program.

2019 IMPROVEMENT PROGRAM

CITY PROJECT NO. 2017-17

DICKMAN TRAIL WET EXTENDED DETENTION BASIN 

Nature of Work 

Stormwater low-flow diversion, stormwater treatment basin and storm sewer outlet structure. 

Affected Area 

On the block near the intersection of the old railroad tracks and River Road. Four (4) parcels comprised of one City-owned (former City Hall) and three residential properties abut the stormwater improvement project. One (1) City-owned parcel and City stormwater utility easement is the site of the proposed project. This facility will also serve ten parcels in the vicinity of Dickman Trail and Dixie Avenue.

Estimated Cost of Improvements 

The total estimated cost is $599,000. Persons desiring to be heard with reference to the proposed improvements will be heard at the time and place of the public hearing. Written and oral objections will be considered at the public hearing. 

Proposed Project Funding 

The project is funded 80% through a grant with the Minnesota Pollution Control Agency Point Source Implementation Program. The City’s cost share is 20% which is provided by stormwater utility funds or other means as determined by City Council. No special assessments are planned for this project. 

Written comments should be filed with the Municipal Clerk at City Hall, 8150 Barbara Avenue, Inver Grove Heights before the hearing; otherwise written comments may be filed with the Clerk at the Hearing.

On August 15, 2018, the Northern Dakota County Cable Communications Commission, (“NDC4”), on behalf of its seven Member Cities (Inver Grove Heights, Lilydale, Mendota, Mendota Heights, South St. Paul, Sunfish Lake, and West St. Paul, Minnesota), received a Formal Renewal Proposal for a Cable Franchise (“Formal Proposal”) from Comcast of St. Paul, Inc., (“Comcast”) a cable television provider franchised to do business in the seven Member Cities. 

The public is invited to inspect a copy of Comcast’s Formal Proposal and the NDC4 Formal Community Needs Assessment, during regular business hours, at the NDC4 office located at 5845 Blaine Avenue, Inver Grove Heights, MN 55076-1401. CITY OF SOUTH ST. PAUL

NOTICE OF PUBLIC HEARING 

TO WHOM IT MAY CONCERN: 

Notice is hereby given that the South St. Paul Planning Commission will hold a Public Hearing on Wednesday, September 5, 2018 at 7:30 P.M. or as soon thereafter as the matter can be heard in the City Council Chambers of City Hall, 125 Third Avenue North, South St. Paul to consider the following: 

1) An application by Lodge Properties, LLC, Box 2188, Stillwater, MN 55082, to consider an amendment to the text of City Code Section 118-126 regarding the C-1 Retail Business District to allow for the operation of pet daycare, pet boarding, pet grooming, and veterinary uses in the district. 

2) An application for a Conditional Use Permit/parking variances for the reuse of the building at 103 Concord Exchange North by Vandalia Glassworks, 550 Vandalia Street, #205, St. Paul, MN 55114. The applicant proposes to house its glass art studio with classrooms, an art gallery and space for a retail tenant in the building. The subject property is 103 Concord Exchange North which is generally located south of Veteran’s Memorial Drive, west of Concord Exchange North, east of the bluff and north of Bridgepoint Drive. 

3) An application by Israel United In Christ, 7400 Penn Avenue South, Richfield, MN 55423 for a Conditional Use Permit to allow for a church use in the existing building at 490 Villaume Avenue. The property is generally located east of Concord Street South, north of I-494, south of Villaume Avenue and west of Hardman Avenue. 

4) An application from Charles Sartell, 201 Liberty Place, South St. Paul, MN 55075 for a 12-foot front yard setback variance and 5-foot side yard setback to accommodate the construction of an attached 2-car garage and mudroom. The Planning Commission will hold a joint work session with the Economic Development Advisory Board and Economic Development Authority prior to the regular meeting to discuss the 2018 Comprehensive Plan Update. The South St Paul Housing and Redevelopment Authority (HRA) will accept sealed bids for the furnishing of all labor, materials, tools, equipment, and services necessary for sprinkler head replacement and all associated work required to install same as shown in bid documents. Bids will be received until 2:00 p.m. (local time) September 20th, 2018, at the South St Paul Housing and Redevelopment Authority, 125 Third Avenue North, South St. Paul, MN 55075. At which time bids will be publicly opened and read aloud. 

A mandatory pre-bid walkthrough is scheduled for September 6, 2018 at 2:00 PM (local time). Prime Contractors interested in bidding are required to attend. Prime Contractors that have previously attended a pre-bid walkthrough on this project need not to attend; your previous attendance fulfills this bidding requirement. It is the Housing and Redevelopment Authority’s intention to award a single prime contract to the lowest bid for the project based on available funding. The projects construction start is anticipated to be October/November 2018. 

It is the Bidder’s responsibility to inquire as to the addenda issued. 

A certified check or bank draft, payable to the order of the South St. Paul Housing and Redevelopment Authority, negotiable U. S. Government Bonds (at par value) or a satisfactory bid bond executed by the Bidder and an acceptable surety, in the amount of five percent (5%) of the total bid, must be submitted with each bid. 

No less than minimum salaries and wages set forth in the contract documents must be paid on this project (Davis-Bacon). Contractors must take affirmative action to ensure that employees and applicants for employment are not discriminated against because of race, color, creed, religion, national origin, sex, marital status, age, sexual orientation, disability, familial status or status with regard to public assistance. HUD, Section 3 Compliance & Documentation are required on this project as stipulated in the Bid Documents and HUD Standards. 

Successful bidders must furnish and pay for a satisfactory performance and payment bond or bonds, in the penal sum of the full amount of the contract as awarded. 

The South St Paul Housing and Redevelopment Authority reserves the right to reject any or all bids, to waive any informalities in the bidding and to award the contract to the lowest responsible bidder.

SCHOOL BOARD MEETING AND WORK SESSION 

A school board meeting and work session were held at 5:00 p.m. on Monday, August 20, 2018 at Henry Sibley High School, Room A-241, 1897 Delaware Avenue, Mendota Heights, MN. The following board members were present: Brenda Corbett, Stephanie Levine, Joanne Mansur, Maureen Ramirez, Byron Schwab and Terry Stamman. Board member John Chandler was absent. Superintendent Peter Olson-Skog was present. 

Motions carried to approve the agenda and consent agenda. The consent agenda included the minutes from the August 5, 2018 meeting; personnel recommendations; final reading of Policy 612.1; review of Policies 522, 730 and 807; June 2018 accounts payable and treasurer’s reports. 

A first reading of Policy 722, Public Data Requests, was presented. 

A motion carried to approve the agreement between School District 197 and the International Association of Machinists and Aerospace Workers, District Lodge No. 77. 

A second reading of Policy 505, Distribution of Non-School Sponsored Materials on School Premises by Students and Employees, was presented. 

A work session followed. Updated were provided on the facilities design process, Warrior Seminar and Policy 534 (unpaid meal charges). 

The meeting adjourned at 7:25 p.m. 

The next regularly scheduled School Board meeting of Independent School District 197 is scheduled for Wednesday, September 5, 2018 at 6:00 p.m. at the Mendota Heights Council Chambers, 1101 Victoria Curve, Mendota Heights, MN.
