The Maplewood city council has adopted four ordinances (Nos. 988, 989, 990, and 991, collectively the “Ordinances”) which increase the city’s natural gas and electric franchise fee on Northern States Power Company, the utility which provides gas and electric service within Maplewood under franchise agreements with the city. The new rates, effective November 1, 2018, will be $3.00 per month for gas and $3.00 per month for electric service for residential customers. The current franchise fee is $1.25 per month for each utility for residential customers. Other rates apply to non-residential customers. The city intends to use the revenues raised by the franchise fees for public improvement projects and other purposes. Northern States Power Company will pass the franchise fees onto its customers, resulting in a small increase in utility bills for customers. Full copies of the Ordinances are available in the office of the city clerk. 

This ordinance shall be effective after its adoption, publication and 90 days after the sending of written notice enclosing a copy of this adopted ordinance to NSPM by certified mail. What is the Request? 

The Economic Development Coordinator of the city of Maplewood is requesting that the Maplewood city council hold a public hearing to consider the establishment of a storm sewer improvement tax district for the new Beebe Meadows subdivision. 

Public Hearing Information 

The Maplewood city council will hold a public hearing regarding the proposed storm sewer improvement tax district on Monday, August 27, 2018, at 7:00 p.m. or later. The public hearing will be held in the city council chambers at Maplewood city hall, 1830 County Road B East, Maplewood, Minnesota. CITY OF MAPLEWOOD PUBLIC HEARING NOTICE 

What is Being Requested? 

St. Paul Regional Water Services (SPRWS) owns the Sandy Lake site located south of County Road B, west of Interstate 35E, north of Roselawn Avenue, and east of the Soo Line Railroad tracks (PIN 18-29-22-12-0011). The site is approximately 75 acres and is currently used for stockpiling and recycling soil, rubble, and crushed aggregate generated through water main replacement work. The current operations take place from 8 a.m. to 5 p.m., Monday through Friday. SPRWS is proposing to expand the Sandy Lake stockpiling operation to nighttime hours for emergency water main breaks and scheduled after-hours work. The recycling operation (crushing of rubble and aggregate) will continue during daytime hours only.

ORDINANCE NO. 762

AN ORDINANCE AMENDING THE NORTH SAINT PAUL CITY CODE OF ORDINANCES TITLE XI, BUSINESS REGULATIONS, CHAPTER 117, ALCOHOLIC BEVERAGES 

THE CITY COUNCIL OF THE CITY OF NORTH ST. PAUL, MINNESOTA ORDAINS: 

SECTION 1. Section 117.155 of the North St. Paul City Code is hereby repealed and replaced in its entirety as follows: 

§ 117.155 CONDITIONS OF LICENSE; HOURS OF SALE. 

A licensee under this chapter shall make no sale of or furnish any alcoholic beverage during the following hours on the following days: 

(A) Off-sale licensees. No off-sale of any alcoholic beverage or liquor may be made: 

(1) On Sundays, except between the hours of 11:00 a.m. and 6:00 p.m.; 

(2) Before 8:00 a.m. on Monday through Saturday; 

(3) After 10:00 p.m. on Monday through Saturday; 

(4) On Thanksgiving Day; 

(5) After 8:00 p.m. on Christmas Eve, December 24, unless a Sunday, then after 6:00 p.m.;

(6) On Christmas Day, December 25. 

(B) On-sale licensees. No sale of any alcoholic beverage for consumption on the licensed premises may be made: 

(1) Before 8:00 a.m. on Monday through Saturday; 

(2) After 1:00 a.m. on Monday through Saturday; 

(3) After 1:00 a.m. on Sunday, except as allowed in § 117.160. 

SECTION 2. Section 117.160 of the North St. Paul City Code is hereby repealed and replaced in its entirety as follows: 

§ 117.160 SUNDAY SALES LICENSES. 

Special licenses for the sale of intoxicating liquor on Sundays shall be issued only under the following conditions: 

(A) The holder of an “on-sale” liquor license may apply to the Council for a Sunday sales license pursuant to which such licensee may sell intoxicating liquor for consumption on the licensed premises between the hours of 8:00 a.m. on Sundays and 1:00 a.m. on Mondays in conjunction with the sale of food, provided that the licensee is in conformance with the Minnesota Clean Air Act; 

(B) No Sunday sales license shall be issued contrary to state law; 

(C) All the requirements of this chapter are followed; 

(D) No Sunday sales license may be issued to an on-sale licensee unless the licensee operates a restaurant as defined in § 117.015, serving meals regularly to the public and having facilities for serving at least 30 diners at the same time, at least 24 of which must be at tables separate from the bar. Establishments must also comply with § 117.126; 

(E) Any on-sales licensee who requests a certificate of compliance for Sunday sales and which is refused such a certificate by the City Manager may appeal the same to the Council within ten days after the refusal and payment of a $200 fee to cover the costs of the appeal by the city. The Council shall consider all such evidence as it considers valid in determining whether or not the licensee is eligible for a Sunday sales license. Only one such request shall be allowed each license year; 

(F) Any Sunday sales licensee who offers for sale any intoxicating liquor before 8:00 a.m. on Sundays or after 1:00 a.m. on Mondays, shall be considered as violating the liquor law and shall, as penalty, forfeit its Sunday liquor license for at least a one-year period, in addition to any other penalties that may be applicable, and/or any other sanctions imposed by the City Council. 

SECTION 3. Section 117.340 of the North St. Paul City Code is hereby repealed in its entirety. 

SECTION 4. This ordinance shall be effective immediately upon its passage and publication.

SECTION 2. Section 154.010 (J)(9)(e)(v): of the North St. Paul City Code is hereby amended as follows: 

(e) Driveways, authorized parking areas, and authorized garages. 

v. Driveways located on a corner lots shall be set back a minimum of 15 feet from the corner of the two streets fronting the lot. 

SECTION 3. Section 154.010 (J)(10)(h): of the North St. Paul City Code is hereby added as follows:

Sealed bids for Bulk Waste Residual Load Out Construction Project will be received at the Recycling & Energy Center, 100 Red Rock Road, Newport, Minnesota, 55055 until September 7th at 2:00 p.m., local time, at which time they will be opened. The major work items generally include: 

Project includes selective demolition and removal of concrete retaining walls, interior and exterior concrete push walls, exterior metal wall panels, excavation of a load-out pit and ramp, soil excavation and removal, construction of concrete floors and push walls, construction of concrete retaining walls, construction of a 2-story metal building for cold storage on the first floor and finished space on second floor, construction of asphalt roadways, and includes all associated mechanical, electrical and plumbing.

NOTICE IS HEREBY GIVEN, that North St. Paul-Maplewood-Oakdale Independent School District 622, will receive sealed Bids at the North St. Paul-Maplewood-Oakdale District Education Center, 2520 East 12th Street, North St. Paul, Minnesota 55109, for the Castle Elementary School Addition and Renovations, Bid Package #1 until 2:00 pm local time, Thursday, August 16th for the purpose of furnishing all materials, labor, equipment and skill required for the construction of the above said project. 

Sealed Bids shall be mailed or delivered to the North St. Paul-Maplewood-Oakdale Independent Education Center no later than 2:00 pm local time, Thursday, August 16th, 2018. Bids received will be publicly opened and read aloud. Bids received after the close of bids will not be accepted and returned to the Bidder. The Castle Elementary School Addition and Renovations, Bid Package #1 will include bidding the below work scopes.

Each bid shall be accompanied by a bid security in the form of a bid bond, certified check or cashier’s check, in a sum equal to five percent (5%) of the maximum bid price, executed by the Bidder as principle and by surety company authorized to do business in the State of Minnesota, payable to North St. Paul-Maplewood-Oakdale Independent School District 622, conditioned that if the principle’s bid be accepted and the contract awarded to the Bidder, the Bidder will within ten (10) days after Notice of Award has been executed, will execute and effect a contract in accordance with the terms of the Bidders bid and a contractor’s bond as required by law and regulations. 

The bid security of the two lowest bidders will be retained until the Notice of Award has been executed, but no longer than sixty (60) days. The bid security is a guarantee that the Bidder will enter into a contract for the work described within the Bidding and Contract Documents. Countersignature of a bid bond is not required under this section. 

The provisions of Minn. Stat. 16C.285 Responsible Contractor are imposed as a requirement of this contract. All bidders and persons or companies providing a response/submission to the Advertisement for Bids shall comply with the provisions of the statute. Prevailing wages apply. 

Successful Bidders will be required to furnish a Contract Performance Bond and Payment Bond in the full amount of the Contract. 

No Bids may be read or considered if it does not fully comply with the requirements of this Advertisement for Bids and any Bids received that are deficient with the requirements of this section will be resealed and returned to the Bidder immediately. 

Bids will be awarded on the basis of the lowest, responsible and responsive Bidder as determined most favorable to North St. Paul-Maplewood-Oakdale Independent School District 622’s best interest. North St. Paul-Maplewood-Oakdale Independent School District 622 reserves the right to reject any and all Bids, to waive any informality in any Bid, and to hold all Bids for a period of sixty (60) days from the date of opening Bids.
