NOTICE OF ASSESSMENT LIEN FORECLOSURE SALE 

YOU ARE NOTIFIED THAT, 

1. Default has occurred in the conditions of the Condominium No. 30 Declaration for Condominium Alderwood Condominium, Washington County, Minnesota, by Danielle N. Sobaski, as fee owner of the below-described property subject to said Declarations. 

2. Pursuant to the Condominium No. 30 Declaration for Condominium Alderwood Condominium filed for record with the Washington County Recorder on February 24, 1982 as Document No. 428742 and all amendments thereto, and Minnesota Statutes, a statutory lien exists for unpaid assessments and fees incurred from January 1, 2018 to the date of this notice. 

3. No action or proceeding has been instituted at law to recover the debt secured by the statutory lien or any part thereof, or if an action has been instituted it has been dismissed or discharged prior to the commencement of these proceedings. 

4. The holder of the lien has complied with all conditions precedent to acceleration of the debt secured by the assessment lien and foreclosure of said lien, and all notice and other requirements of applicable statutes. 

5. As of the date of this notice the amount due, pursuant to the Association’s Declarations and By-laws, is $4,561.90. 

6. As of the date of this notice, the names of all parties that have been released from liability for the assessment lien are as follows: NONE. 

7. Pursuant to the provisions of the Condominium No. 30 Declaration for Condominium Alderwood Condominium, the lien will be foreclosed and the land located at 6347 Alderwood Circle #E, Woodbury, Minnesota 55125, in the County of Washington, State of Minnesota, legally described as follows:

The Washington County Sheriff’s department and the Oakdale Police Department shall help the Petitioner execute and/or serve this Order, without charge. Peace officers licensed by the State of Minnesota and correction officers, including, but not limited to, probation officers, court services officers, parole officers and employees of jails or correctional facilities may serve an Order for Protection. If the application for relief is brought in a county in which the Respondent is not present, the sheriff shall forward the pleadings necesary for service upon the Respondent to the sheriff of the county in which the Respondent is present. This must be expedited to allow for timely service. 

Under federal law, every Police Department and Sheriff’s office in the United States, including Washington D.C. and tribal and terrirorial lands, is responsible for enforcing this order. Enforcement of this order may include, but is not limited to, assisting in obtaining physical custody of child(ren), removing respondent from the residence, and getting property back from the respondent. 18 U.S.C. § 2265. 

Respondent is ordered not to ship, transport, possess or receive any firearm or ammunition for the duration of this Order. 

X Within three business days from the date this order is issued, respondent shall transfer any firearm that the respondent possesses to a federally licensed firearms dealer, a law enforcement agency, or a third party who may lawfully receive them pursuant to Minn. Stat. § 518B.01 subd. 6(g). If the transfer of firearms is to a third party, the third party must be a person who lawfully may possess firearms and cannot be a person who resides with the Respondent. 

Respondent shall file with the court an Affidavit / Proof of Transfer within two business days from the date the firearms were transferred. 

If local law enforcement retains possession of the firearms, the agency may charge a reasonable fee to store the respondent’s firearms, and shall return the firearms to respondent upon request after the expiration of this Order, provided the respondent is not otherwise prohibited from possessing firearms under state or federal law. 

This Order for Protection is effective for a period of two years from the date of this Order. 

You are also restrained from harassing, stalking, or threatening the protected person(s), or engaging in other conduct that would place the protected person(s) in reasonable fear of bodily injury to that person; and you are prohibited from the use, attempted use, or threatened use of physical force against the protected person(s) that would reasonably be expected to cause bodily injury. 18 U.S.C. § 922(g)(8)(B) and (C). 

NOTICES TO RESPONDENT: 

• A police officer shall arrest you and take you to jail if the police officer believes you have violated this Order and shall hold you in jail for at least 36 hours, excluding the day of arrest, Sundays, and holidays, unless you are released earlier by a judge or judicial officer. 

• Violation of this Order may be treated as a misdeameanor, gross misdemeanor, or felony. A misdemeanor violation may result in a sentence of up to 90 days in jail and/or a fine of up to $1,000. Some repeat violations are gross misdemeanors which may result in a sentence of up to one year in jail and/or a fine of up to $3,000. Other violations are felonies and may result in a sentence of imprisonment for up to five years and/or a fine of up to $10,000. 

• This order is entitled to full faith and credit and shall be enforced anywhere in the U.S. including Tribal lands. 18 U.S.C. § 2265. Crossing state, territorial, or tribal boundaries to violate this order may reslut in federal imprisonment. 18 U.S.C. § 2262.

• Federal law prohibits shipping, transporting, possessing or receiving firearms or ammunition while this order is in effect and upon conviction of a crime of domestic violence. 18 U.S.C. § 922(g)(8). 

• If an Order for Protectioon is issued, the Court must consider the Order in making a decision in any parenting time (visitation) proceeding, if requested by Petitioner. 

• If an Order for protection is issued under Minn. Stat. § 518B.01 subd. 6(b) for any length of time exceeding two years, the respondent must wait five years to seek a modification of the order.

TO: THE DISTRICT COURT ABOVE NAMED 

The County of Ramsey brings this Petition and respectfully states and alleges: 

I. 

That this proceeding is taken pursuant to law in the name of and on behalf of the County of Ramsey, State of Minnesota, by John J. Choi, the duly elected, qualified and acting County Attorney, at the request of the Board of County Commissioners of Ramsey County, as shown by County Board Resolution No. B2017-039, dated February 14, 2017, a certified copy of which is attached hereto as Exhibit A and made a part hereof.

II. 

That the County of Ramsey also deems it necessary, expedient, and for a public use and purpose to obtain by “quick take” condemnation under the right of eminent domain the respective fee simple title, permanent easements and temporary construction and building removal easements in the lands as described in this Petition, together with all structures, trees, shrubs, grass and herbage to be damaged thereby. 

III. 

Where “fee title” is identified, the interests being conveyed is fee simple title.

IV. 

Where a “permanent easement” is identified, the interests being conveyed include all rights necessary for the construction, operation, and maintenance of all public right-of-way and utility uses now known or adopted in the future. Such rights include, but are not limited to: to remove and use all plants, trees, ground cover, and natural growth now existing, or later planted or grown; to permanently grade or alter the grade of the land, and to remove and use all earth and other material not reasonable necessary for lateral and subjacent support; to limit or allow all rights of access to the public right-of-way from the adjoining land; to store equipment or supplies; to access, both ingress and egress, from reasonably convenient rights-of-way; to remove any physical improvements or fixtures; and to exclude from the area any use or improvement that conflicts with the rights conveyed herein.

V. 

Where a “temporary easement” is identified, the interests being conveyed include all rights of possession and use, for a limited period of time, necessary or incidental to support the related construction project, including the right: to store equipment or supplies (except hazardous waste); to stage equipment or supplies; to access other portions of the construction project; to permanently grade or alter grade of the land; to remove (and restore in substantially similar condition) any plants, ground cover, or physical improvements; to access, both ingress and egress, from reasonably convenient rights-of-way; and to install any temporary improvements. The term of the temporary easement shall be for 24 months beginning on November 1, 2018, plus two options whereby the Petitioner may elect to extend the term of the temporary easement for six-months each. The election will be made 30 days prior to expiration of then current term upon remittance of a payment as identified in the Petitioner’s appraisal of damages.

VI. 

Where “Access Rights” is identified, the interests being conveyed include all rights of ingress and egress by any highway use from the remainder of the subject to the right-of-way identified.

VII. 

Where a “temporary building removal easement” is identified, the interests being conveyed include all rights of possession and use, for a limited period of time, necessary or incidental to remove all physical improvements, including the right: to store equipment or supplies (except hazardous waste); to permanently grade or alter grade of the land; to remove any plants or ground cover; to access, both ingress and egress, from reasonably convenient rights-of-way; and to install any temporary improvements. The term of the temporary building removal easement shall be from May 1, 2019 to June 29, 2019.

VIII. 

Personal property not specifically identified as being acquired, including, but not limited to, fencing, irrigation systems, pavement, curbing, or signage, or trees, shrubs, plants, or ground covering, is not included in this petition, except to the extent the above rights provide for the removal, replacement, use, or repair of such property. It is the intention of the Petitioner to address any claim of damage related to personal property destroyed, removed, lost, or otherwise damaged, but not repaired or replaced in substantially similar condition, in accordance with applicable relocation laws, including Minn. Stat. § 117.50 - .56 or the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970, as amended, and any regulations adopted pursuant thereto. 

IX. 

That the purpose for which said interests in land described in this Petition are being acquired is for the widening, addition to and realignment of Rice Street at Highway 694 for the purpose of public travel and transportation and related uses.

X. 

The taking in this matter is to obtain rights sufficient to support the construction and maintenance of a public highway, including related facilities. Pre-existing utility and other easements or interests which do not interfere with the interests being acquired or the right of the County of Ramsey to construct and maintain a public highway on the land being acquired will remain in full force and effect. If any parcel being taken by this condemnation proceeding is subject to a pre-existing utility or other easement or interest, the County of Ramsey will work as needed with the easement holder to adjust facilities to accommodate the construction or to adjust construction plans to reduce related damages.

XI. 

It is the intent of the Petitioner that reasonable access, in at least one direction, to the main thoroughfare will be maintained for any remaining interest of a property from which a permanent or temporary easement is taken.

XII. 

Notwithstanding anything to the contrary contained herein, should tests or evaluations undertaken by or on behalf of the County of Ramsey indicate the possible presence of pollutants, contaminants, or hazardous substances on any of the property described in this Petition, the County of Ramsey reserves the right to defer effecting the transfer of the interest to any of the property as described herein for a reasonable time until the County of Ramsey can evaluate whether it wishes to proceed with the taking, abandon these proceedings and dismiss the Petition as to said property, or otherwise respond to such information. 

Further, the County of Ramsey reserves the right to recover costs of clean-up and testing and all other damages resulting from the presence of pollutants, contaminates, or hazardous substances on the property described herein, from all potentially responsible parties in a separate legal action.

XIII. 

That a party wishing to challenge the public use or public purpose, necessity, or authority for a taking must appear at the hearing of this Court at which the County of Ramsey, as Petitioner, shall present this Petition to the Court and state the objection or must appeal within 60 days of a Court order.

XIV. 

That the land in these proceedings to be taken are situated in Ramsey County, Minnesota and are more particularly described in attached Exhibit B which is made a part hereof. The names of all persons appearing of record or known to the County of Ramsey to be the owners of said land, or interested therein, including all whom the County of Ramsey has been able by investigation and inquiry to discover, together with the nature of the ownership of each, as nearly as can be ascertained, are set forth on attached Exhibit B.

XV. 

The County of Ramsey hereby moves the court for an order transferring title and possession of the parcels described herein prior to filing of an award by the court appointed commissioners, pursuant to Minnesota Statutes § 117.042. 

WHEREFORE, the County of Ramsey prays for an order of this Court as follows: 

1. Adjudging that said taking is for a public purpose, is necessary, and is authorized by law; and 

2. It be further adjudged that the County of Ramsey is entitled to take and hold such property for the public use pursuant to the Notice of Intent to Take Possession, on file with this Court; and 

3. Appointing three disinterested commissioners, and at least two alternates, to ascertain and report the amount of damages that will be sustained by the several owners on account of the taking; fixing the time and place of the first meeting of the three commissioners; prescribing their compensation; establishing procedures for the disbursement of funds deposited with the district court; establishing procedures by which commissioners shall hear all allegations and proofs of persons interested herein; and requiring the commissioners to file their report with the District Court Administrator within 180 days from the date of the order appointing the commissioners unless said time be further extended by order of the Court; and 

4. For such other and further relief as may be proper and pursuant to law.

What is the Request? 

The Finance Director of the City of Maplewood is requesting that the Maplewood Planning Commission review the proposed 2019-2023 Maplewood Capital Improvement Plan (CIP). 

Public Hearing Information 

The Maplewood Planning Commission will hold a public hearing regarding the proposed CIP on Tuesday, July 17, 2018, at 7:00 p.m. or later. The planning commission will hold this meeting at Maplewood City Hall, 1830 County Road B East, in the City Council Chambers. On June 11, 2018, the City Council of the City of Maplewood adopted Ordinance Nos. 978 through 985, ordinances which create or amend city code to allow for urban agriculture uses. A summary of the ordinances follows:

Ordinance No. 978

An Ordinance Allowing the Keeping of Bees 

1. Allow beekeeping in any zoning district as a permitted use. 

2. Hive placement requirements as follows: 

a. Located at least five feet from any property line with the front of the hive facing in toward the property. 

b. Located at least ten feet from a public sidewalk with the front of the hive facing in toward the property. 

c. Located at least 25 feet from a principal building on an adjoining lot.

Ordinance No. 979

An Ordinance Allowing the Keeping of Poultry in All Zoning Districts 

1. Allowing other types of poultry in addition to chickens (i.e., quail and pheasants) 

2. Changing the neighborhood consent requirements from 100 percent to 60 percent consent for approval of a poultry permit. 

3. Allowing the keeping of poultry on property that is not zoned single family residential with a permit.

An Ordinance Allowing the Temporary Keeping of Goats and Sheep 

1. Allow the temporary keeping of goats and sheep (up to 60 days) for vegetative management with a permit.

1. Allow community gardens one acre or under as a permitted use in any zoning district with standards such as setbacks, time limits for sale of produce, etc. 

2. Allow community gardens over one acre in any zoning district with a conditional use permit.

An Ordinance Allowing Front Yard Gardening and Permaculture 

1. Adding text that makes it clear that front yard gardening is a permitted use in all residential zoning districts.

An Ordinance Allowing Urban Farms 

1. Allow urban farms on park land if it meets the City’s Park Master Plan. 

2. Allow urban farms in all other zoning districts with a conditional use permit.

NOTICE OF PUBLIC HEARING TO CONSIDER GRANTING A PROPOSED PROPERTY TAX ABATEMENT 

NOTICE IS HEREBY GIVEN that the School Board of Independent School District No. 622 (North St. Paul-Maplewood-Oakdale), North St. Paul, Minnesota (the “District”) will hold a public hearing on July 24, 2018, at approximately 4:25 o’clock p.m. in the Board Room of the District 622 Education Center, 2520 East 12th Avenue, North St. Paul, MN 55109, to consider granting an abatement of certain property taxes levied against net tax capacity imposed by the District (the “Proposed Property Tax Abatement”) for taxes payable in 2019 through 2025 on the following properties within the District boundaries:

The total estimated amount of the Proposed Property Tax Abatement by the District is $1,526,610 over seven (7) years, an amount estimated to be sufficient to pay the principal and interest on $1,130,000 of bonds issued to finance the parking lot projects, and related financing costs.

BE IT RESOLVED that the School Board of Independent School District 622 approve and adopt the Commissioners of Health and Education model plan for lead-in-water testing in all District buildings. 

Livingston moved and Neve seconded the following resolution, which carried on a 7 – 0 vote: 

BE IT RESOLVED by the School Board of Independent School District No. 622, State of Minnesota, as follows: 

1. The school board of Northeast Metropolitan Intermediate School District No. 916 has approved a long term facility maintenance budget for its facilities for the 2019-2020 school year in the amount of $105,895. The various components of this program budget are attached as EXHIBIT A hereto and are incorporated herein by reference. Said budget is hereby approved. 

2. Minnesota Statutes, Section 123B.595, Subdivision 3, as amended, provides that if an intermediate school district’s budget is approved by the school boards of each of the intermediate school district’s member school districts, each member district may include its proportionate share of the costs of the intermediate school district program in its long term facility maintenance revenue application. 

3. The proportionate share of the costs of the intermediate school district’s long term facility maintenance program for each member school district to be included in its application shall be determined by utilizing a blended rate where half of the rate is determined by multiplying the total cost of the intermediate school district long term facility maintenance times the ratio of the member school district’s net tax capacity to the total net tax capacity of the intermediate school district and half of the rate is determined by multiplying the total cost of the intermediate school district long term facility maintenance times the ratio of ADM utilization by district to the total ADM utilization. 

The inclusion of this proportionate share in the district’s long term facility maintenance revenue application for fiscal year 2019 is hereby approved, subject to approval by the Commissioner of the Minnesota Department of Education. 

4. Upon receipt of the proportionate share of long term facility maintenance revenue attributable to the intermediate school district program, the district shall promptly pay to the intermediate school district the applicable aid or levy proceeds. 

Augé moved and Livingston seconded the following resolution, which carried on a 7 – 0 vote: 

BE IT RESOLVED by the School Board of Independent School District 622 that the lease extension for the Next Step facility in North St. Paul, MN at 2586 East 7th Street, Suite 100 be approved for a five-year period through July 31, 2023 as stipulated in Amendment #2 to the Lease Agreement. 

Anderson moved and Livingston seconded the following resolution, which carried on a 7 – 0 vote:

A copy of this list may be viewed at the Property Records and Taxpayer Services department located at the Washington County Government Center in Stillwater. 

Commissioner Lavold made a motion to approve the list as submitted 

Commissioner Weik seconded the motion. The motion carried. 

All County Board members signed the County Board Certification form. 

Commissioner/Chair Kriesel thanked the staff for the accuracy of their work. He again encouraged staff to respond to the property owners before the second meeting to let them know that their information was considered and to explain the staff recommendation. He went on to say that it is remarkable that with over 110,000 parcels to have such a low number of appeals.

After all appeals were heard Auditor Corbid stated that statute requires we offer appointments after 7:00 p.m. but none were requested. 

Commissioner Lavold made a motion to recess the meeting. It was seconded by Commissioner Miron. The motion carried.

Osorio explained her new role as the MAASS President, a regional organization for superintendent development, and that she would be running their upcoming conference. She also discussed the timeline for her annual review and the possibility of forthcoming work sessions as the District’s facilities work progresses. 

R. Anderson presented the following 2018-2019 budgets for Board review: Fund 1 (General Fund); Fund 2 (Food Service); Fund 4 (Community Education); Fund 7 (Debt Service); Fund 9 (Trust); Fund 20 (Self-Insured Health Insurance); Fund 45 (OPEB Fund); and Fund 47 (OPEB Debt Service). Approval of all budgets will be proposed for action at the June 26, 2018 business meeting.
