NOTICE IS HEREBY GIVEN, that North St. Paul-Maplewood-Oakdale Independent School District 622, will receive sealed Bids at the North St. Paul-Maplewood-Oakdale District Education Center, 2520 East 12th Street, North St. Paul, Minnesota 55109, for the Castle Elementary School Addition and Renovations, Bid Package #1 until 2:00 pm local time, Thursday, August 16th for the purpose of furnishing all materials, labor, equipment and skill required for the construction of the above said project.

The bid security of the two lowest bidders will be retained until the Notice of Award has been executed, but no longer than sixty (60) days. The bid security is a guarantee that the Bidder will enter into a contract for the work described within the Bidding and Contract Documents. Countersignature of a bid bond is not required under this section. 

The provisions of Minn. Stat. 16C.285 Responsible Contractor are imposed as a requirement of this contract. All bidders and persons or companies providing a response/ submission to the Advertisement for Bids shall comply with the provisions of the statute. Prevailing wages apply. 

Successful Bidders will be required to furnish a Contract Performance Bond and Payment Bond in the full amount of the Contract. 

No Bids may be read or considered if it does not fully comply with the requirements of this Advertisement for Bids and any Bids received that are deficient with the requirements of this section will be resealed and returned to the Bidder immediately.

CERTAIN CAPITAL PROJECTS

INDEPENDENT SCHOOL DISTRICT NO. 622

(NORTH ST. PAUL-MAPLEWOOD-OAKDALE)

STATE OF MINNESOTA 

NOTICE IS HEREBY GIVEN that the School Board of Independent School District No. 622 (North St. Paul-Maplewood-Oakdale), State of Minnesota (the “District”), adopted a resolution on July 24, 2018 (the “Resolution”) stating the intention of the School Board to issue a capital facilities portion of an issue of general obligation bonds (the “Bonds”) in the total principal amount of not to exceed $5,000,000 pursuant to Minnesota Statutes, Sections 123B.62, and Chapter 475, as amended. 

A portion of the proceeds of the Bonds (the “Capital Facilities Portion”) in the principal amount of not to exceed $5,000,000 will be used to fund the costs of the following capital improvements to be approved by the School Board and related financing costs, subject to the approval of the Commissioner of Education: 

• improvements and repairs to District buildings and sites; 

• equipping and reequipping buildings with permanent attached fixtures; 

• acquisition of furniture, fixtures and equipment; 

• fire, life and safety code compliance projects; and 

• facility improvements to enhance safety and security. 

Pursuant to Minnesota Statutes, Section 123B.62, as amended, the Capital Facilities Portion of the Bonds will be finally authorized for issuance, subject to the approval of the Commissioner of Education, unless a petition calling for a referendum on the question of whether to issue said Capital Facilities Portion, signed by more than fifteen percent (15%) of the registered voters of the District, is filed with the School Board within thirty (30) days of the date of the School Board’s adoption of the Resolution. A petition must be in the form required by law. The minimum number of valid signatures for such a petition shall be determined as of the last day before the petition is filed with the School Board. 

The total amount of outstanding indebtedness of the District as of April 30, 2018 is $81,155,000. If the proposed Capital Facilities Portion of the Bonds are issued, the total indebtedness of the District would be $86,155,000 (not including any other bonds to be issued by the District).

Such assessment is proposed to be payable in equal annual installments extending over a period of fifteen (15) years for single family residential property, the first of the installments to be payable on or before the first Monday in January 2019, and will bear interest at the rate of 5.25 percent per annum from the date of the adoption of the assessment resolution. Interest for one year shall be added to all subsequent unpaid installments. 

You may at any time prior to certification of the assessment to Ramsey County, pay the entire assessment on such property, with interest accrued to the date of payment, to the Finance Department. No interest shall be charged if the entire assessment is paid within 30 days from the adoption of this assessment. You may at any time thereafter, pay to Ramsey County the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made. Such payment must be made before November 15 or interest will be charged through December 31 of the succeeding year. If you decide not to prepay the assessment before the date given above the rate of interest that will apply is 5.25 percent. 

The proposed assessment roll is on file for public inspection at the city clerk’s office. The total amount of the proposed assessment is $616,759.22. Written or oral objections will be considered at the meeting. No appeal to district court may be taken as to the amount of an assessment unless a written objection signed by the affected property owner is filed with the municipal clerk prior to the assessment hearing or presented to the presiding officer at the hearing. The council may upon such notice consider any objection to the amount of a proposed individual assessment at an adjourned meeting upon such further notice to the affected property owners as it deems advisable. 

Under Minn. Stat. §§ 435.193 to 435.195 the council may, in its discretion, defer the payment of this special assessment for any homestead property owned by a person 65 years of age or older or retired by virtue of a permanent and total disability for whom it would be a hardship to make the payments. When deferment of the special assessment has been granted and is terminated for any reason provided in that law and Ordinance (Resolution), all amounts accumulated plus applicable interest become due. Any assessed property owner meeting the requirements of this law may, within 30 days of the confirmation of the assessment, apply to the city clerk for the prescribed form for such deferral of payment of this special assessment on his/her property. 

An owner may appeal an assessment to district court pursuant to Minn. Stat. § 429.081 by serving notice of the appeal upon the mayor or clerk of the city within 30 days after the adoption of the assessment and filing such notice with the district court within ten days after service upon the mayor or clerk.

4. Must be sufficiently screened, as determined by the City, from adjacent residential properties through techniques such as berming and landscaping. 

5. Accessory uses to bus terminals may include an office and routine maintenance of school buses, including but not limited to washing and fueling.

AN ORDINANCE AMENDING THE CITY CODE TO 

DEFINE PERMITTED USES 

IN THE CITY 

THE CITY COUNCIL OF THE CITY OF LANDFALL VILLAGE DOES ORDAIN: 

That The City of Landfall Village Municipal Code, § 670.02, is hereby amended to reflect the City’s policy regarding Utility and Storage Sheds in the City. 

Sec. 670.02 Standalone Utility and Storage Sheds. 

A. Shall be no larger than 144 square feet. All sheds must have a solid floor, with skid or joist sufficient to allow unit to be moved when necessary. 

B. Be in good condition or repairs. 

C. Exterior finished with metal, vinyl, siding,paint, or stain and color to be compatible with home. 

D. Placed on lot 10 feet or more from neighboring home and minimum of 3 feet from retaining wall. 

E. Permits required for all sheds prior to placement with copy of site plan attached. 

F. One shed per lot. 

G. If required for Park Maintenance, utility and storage shed can be moved by the Landfall Housing and Redevelopment Authority at their expense. If the Landfall HRA determines that a utility or storage shed cannot be moved because the utility or storage shed is in such a state of disrepair then the owner must repair the utility or storage shed or have it removed. 

H. There shall be no temporary structures allowed, for the storage of personal property or being used as a workshop, such as tents, lean-to’s enclosed shelters of any kind. Exemption: Camping tents will be allowed for one week. Screen tents and Sun tents used for recreational purposes must be maintained in good condition. 

I. Shed doors must fit tightly and remain closed at all times except when moving items in and out.

Coborn moved and Neve seconded the following resolution, which carried on a 5 – 0 vote: 

BE IT RESOLVED by the School Board of Independent School District No. 622, State of Minnesota, as follows: 

1. It is necessary for the school district to hold its general election for the purpose of electing three (3) school board members for terms of four (4) years each. 

The school district election clerk shall include on the general election ballot the names of the individuals who file or have filed affidavits of candidacy during the period established for filing such affidavits, as though they have been included by name in this resolution. The clerk shall not include on the ballot the names of individuals who file timely affidavits of withdrawal in the manner specified by law. 

2. The general election is hereby called and directed to be held in conjunction with the state general election on Tuesday, the 6th day of November, 2018. 

3. Pursuant to Minnesota Statutes, Section 205A.11, the precincts and polling places for this general election are those polling places and precincts or parts of precincts located within the boundaries of the school district and which have been established by the cities or towns located in whole or in part within the school district. The voting hours at those polling places shall be the same as for the state general election. 

4. The school district election clerk is hereby authorized and directed to cause written notice of said general election to be provided to the county auditor of each county in which the school district is located, in whole or in part, at least seventy-four (74) days before the date of said general election. The notice shall include the date of said general election and the office or offices to be voted on at said general election. Any notice given prior to the date of the adoption of this resolution is ratified and confirmed in all respects. 

The school district election clerk is hereby authorized and directed to cause notice of said general election to be posted at the administrative offices of the school district at least ten (10) days before the date of said general election. 

The school district election clerk is hereby authorized and directed to cause a sample ballot to be posted at the administrative offices of the school district at least four (4) days before the date of said general election and to cause two sample ballots to be posted in each polling place on Election Day. The sample ballot shall not be printed on the same color paper as the official ballot. The sample ballot for a polling place must reflect the offices, candidates and rotation sequence on the ballots used in that polling place. 

The school district election clerk is hereby authorized and directed to cause notice of said general election to be published in the official newspaper of the school district, for two (2) consecutive weeks with the last publication being at least one (1) week before the date of said election. 

The notice of election so posted and published shall state the offices to be filled set forth in the form of ballot below, and shall include information concerning each established precinct and polling place. 

The school district election clerk is authorized and directed to cause the rules and instructions for use of the optical scan voting system to be posted in each polling place on Election Day. 

5. The school district election clerk is authorized and directed to acquire and distribute such election materials and to take such other actions as may be necessary for the proper conduct of this general election, and generally to cooperate with state, city, township and county election authorities conducting the state general and other elections on that date. The school district election clerk and members of the administration are authorized and directed to take such actions as may be necessary to coordinate this election with those other elections, including entering into agreements or understandings with appropriate municipal and county election officials regarding preparation and distribution of ballots, election administration and cost sharing. 

6. The school district election clerk is further authorized and directed to cause or to cooperate with the proper election officials to cause ballots to be prepared for use at said election in substantially the following form, with such changes in form, color and instructions as may be necessary to accommodate an optical scan voting system.

Optical scan ballots must be printed in black ink on white material, except that marks to be read by the automatic tabulating equipment may be printed in another color ink. The name of the precinct and machine-readable identification must be printed on each ballot. Voting instructions must be printed at the top of the ballot on each side that includes ballot information. The instructions must include an illustration of the proper mark to be used to indicate a vote. Lines for initials of at least two election judges must be printed on one side of the ballot so that the judges’ initials are visible when the ballots are enclosed in a secrecy sleeve. 

7. The name of each candidate for office at this election shall be rotated with the names of the other candidates for the same office in the manner specified in Minnesota law. 

8. If the school district will be contracting to print the ballots for this election, the clerk is hereby authorized and directed to prepare instructions to the printer for layout of the ballot. Before a contract in excess of $1,000 is awarded for printing ballots, the printer shall, if requested by the election official, furnish, in accordance with Minnesota Statutes, Section 204D.04, a sufficient bond, letter of credit, or certified check acceptable to the clerk in an amount not less than $1,000 conditioned on printing the ballots in conformity with the Minnesota election law and the instructions delivered. The clerk shall set the amount of the bond, letter of credit, or certified check in an amount equal to the value of the purchase. 

9. The individuals designated as judges for the state general election shall act as election judges for this election at the various polling places and shall conduct said election in the manner described by law. The election judges shall act as clerks of election, count the ballots cast and submit them to the school board for canvass in the manner provided for other school district elections. The general election must be canvassed by the School Board between the third and the tenth day following the general election. 

10. The School District clerk shall make all Campaign Financial Reports required to be filed with the school district under Minnesota Statutes, Section 211A.02, available on the school district’s website. The clerk must post the report on the school district’s website as soon as possible, but no later than thirty (30) days after the date of the receipt of the report. Osorio briefly discussed potential items that will have further dialogue at the proposed upcoming August board retreat.

A Closed Session was called to order by Chair Yener at 6:38 p.m. for the purpose of evaluating the superintendent. Present were: Chair Yener, Vice Chair Livingston, Clerk Augé, Treasurer Neve, Directors Anderson, Coborn, Hunt, and Superintendent Osorio. 

Osorio left the Closed Session at 7:50 p.m. The Board continued their dialogue, and at 9:07 p.m., Osorio returned to the room. A report of the Superintendent’s Evaluation will be provided at the August 21, 2018 business meeting. 

The Closed Session adjourned at 9:14 p.m.
