CITY OF OAKDALE ORDINANCE NO. 790 AMENDING THE CODE OF ORDINANCES FOR THE CITY OF OAKDALE, CHAPTER 3 – OPEN BURNING. Section 1. The City Council of the City of Oakdale ordains that Chapter 3, Article I, Section 3-1 of the Code of Ordinances, be amended to add the following: Sec. 3-1. Definitions. As used in this article: Wood shall mean dry, clean fuel such as twigs, branches, limbs, presto logs, charcoal, or untreated dimensional lumber. The term “wood” does not include wood that is green, with leaves or needles, rotten, wet, oil soaked, or treated with paint, glue, or preservatives. Clean pallets may be used for recreational fires when cut into appropriate lengths. Section 1. The City Council of the City of Oakdale ordains that Chapter 3, Article I, Section 3-2 of the Code of Ordinances, be amended as follows: Sec. 3-2. Prohibited Generally. No person shall cause or allow the open burning of any sweeping, trash, treated lumber, leaves, straw, paper, grass, refuse, or other combustible materials. This section shall not be construed to prohibit the use of gasfired incinerators of sufficient size and capacity approved by the Minnesota Pollution Control Agency. Section 1. The City Council of the City of Oakdale ordains that Chapter 3, Article I, Section 3-4 of the Code of Ordinances, be amended as follows: Sec. 3-4. Recreational Fire Requirements: 6. The only materials allowed to be burned in recreational fires are is wood; from trees, small branches, brush, or charcoal producing little detectable smoke, odor, or soot beyond the property line. The following materials shall not be burned in recreational fires: treated lumber materials, construction debris, garbage, plastic materials, yard waste, or other waste materials. 8. Recreational fires should not be lit or maintained if the smoke therefrom unreasonably causes discomfort or a negative impact to neighboring properties. If a complaint is lodged and verified by a peace officer or firefighter and, in their opinion, is creating a nuisance situation, the operator may be called upon to extinguish the fire immediately until conditions change or improve. This Ordinance shall take effect after its adoption and publication as provided by law.
