NOTICE OF ASSESSMENT LIEN FORECLOSURE SALE 

YOU ARE NOTIFIED THAT, 

1. Default has occurred in the conditions of the Common Interest Community No. 311 Planned Community Heritage Park Townhomes Declaration, Washington County, Minnesota, by Lawrence U. Uke, as fee owner of the below-described property subject to said Declarations.

Pursuant to the Common Interest Community No. 311 Planned Community Heritage Park Townhomes Declaration, filed in the Office of the County Recorder for Washington County on March 31, 2006 as Document No. 3576834 and all amendments thereto, and Minnesota Statutes, a statutory lien exists for unpaid assessments and fees incurred from March 1, 2015 to the date of this notice.

ORDINANCE NO. 839

AMENDING THE CODE OF ORDINANCES FOR THE CITY 

OF OAKDALE, CHAPTER 25 — ZONING, BY AMENDING CHAPTER 25, ARTICLE 16, TO ADD SECTION 25-118 ADOPTING THE HELMO STATION - PLANNED UNIT DEVELOPMENT DISTRICT (HELMO STATION-PUD). 

The City Council of the City of Oakdale ordains: 

Section 1. The Oakdale Code of Ordinances, Chapter 25 — Zoning, Article 16, is amended to add the following Section: 

Sec. 25-118 HelmoStationPlannedUnitDevelopmentDistrict. 

(a) Purpose. The purpose of the Helmo Station Planned Unit Development (HSPUD) is to: 

1. Provide the background regarding the planning process that resulted in the Helmo Station Area Plan and HSPUD; and 

2. Specify the regulations for Land Use, Circulation, and Parks and Open Space that shall apply to all property in the HSPUD area. 

(b) Regulations. The Helmo Station Planned Unit Development District (Helmo Station-PUD) regulations are set forth in the Helmo Station Planned Unit Development, a copy of which is included as Appendix B of this Chapter 25 “Oakdale Zoning Ordinance.” All submittals for platting, subdivision, and site development shall be in substantial conformance, as determined by the City Council, with those regulations. 

Section 2. This Ordinance shall take effect and be in full force from and after its adoption and publication, as provided by law.

CITY OF OAKDALE

ORDINANCE NO. 841

AN ORDINANCE REPEALING ORDINANCE NO. 829. 

Section 1. Background. 

1.01 A new bus rapid transit line (“BR T Line”) has been proposed to be constructed along what has been identified as the Gateway Corridor that runs through the City of Oakdale (the “City”). According to the proposed plans, a transit station servicing the BRT Line will be located in the City near the intersection of Helmo Avenue and 3rd Street North (the “Proposed Helmo Station”). Based on these developments, it was important for the City to study and review its land use and zoning regulations near the Proposed Helmo Station to ensure that development is consistent with the City’s vision and goals for that area. Minnesota Statutes, Section 462.355, subd. 4 allows the City to adopt an interim ordinance for the purpose of protecting the planning process and the health, safety, and welfare of its citizens. 

1.02 The City Council adopted Ordinance 829 on June 27, 2017 authorizing a study to address the types of development and land uses that are appropriate near the Proposed Helmo Station and identify appropriate changes that should be made to the City’s official land use controls, including but not limited to the City’s Zoning Ordinance and Comprehensive Plan. 

1.03 To ensure that no new construction or expansion within the Moratorium Area occurs that might be inconsistent with any potential future changes in the City’s official controls resulting from the study, the City Council established a moratorium in Ordinance 829 that applied to all applications for development, including new building construction and expansion, within the Moratorium Area, including those that were pending with the City as of the effective date of the ordinance. No new land use or zoning applications or building permits applicable to the Moratorium Area were accepted for review by City staff after the effective date of this Ordinance 829. 

Section 2. Planning and Zoning Study. 

2.01 The planning process incorporated feedback from numerous stakeholders including the Oakdale City Council, affected property owners, adjacent neighbors, and community members throughout the plan development. 

2.02 The planning process included an Environmental Assessment Worksheet and Traffic Study to determine the impacts on infrastructure and the environment of a change in land use for the subject area. 

2.03 The planning process culminated in the creation of the Helmo Station Bus Rapid Transit Oriented Development (BRTOD) Plan (“Plan”) that establishes a framework to guide development in the station area. The City Council accepted the Plan on April 24, 2018. 

Section 3. Changes to the City’s Official Controls. 

3.01 Implementation of the City Council’s vision, as articulated in the Plan, required changes to the land use and zoning regulations for the area around the Helmo Station. On April 24, 2018 the City Council approved an amendment to the City’s 2030 Comprehensive Plan to change the future land use of the subject area to provide for the mix of uses recommended in the plan. 

3.02 The Metropolitan Council reviewed the proposed amendment on June 13, 2018 and found that it conformed to the regional systems plans for transportation, wastewater, and parks; it was consistent with Thrive MSP 2040 and Metropolitan Council policies; and was compatible with the plans of adjacent jurisdictions and determined that the City may place the amendment into effect. 

3.03 The City Council adopted a Planned Unit Development (PUD) zoning district for the subject area on June 26, 2018. The PUD contains the detailed development standards for the area with regard to Land Use, Circulation, and Parks, Trails, and Open Space. The regulations ensure that the vision, as the City Council has defined it in the Plan, is implemented. 

Section 4. Repeal of Ordinance 829. 

4.01 The City Council has found that the changes to the City’s official controls are sufficient to ensure that development in the station area will be consistent with the City’s vision and goals for the area. Therefore, the moratorium placed on the subject area is no longer needed and may be repealed. 

4.02 Ordinance 829 adopted by the City Council on June 27, 2017 establishing a moratorium on the Helmo Station area is hereby repealed. 

4.03 This Ordinance shall take effect and be in full force from and after its adoption and publication, as provided by law.
