NOTICE OF ASSESSMENT LIEN FORECLOSURE SALE 

YOU ARE NOTIFIED THAT, 

1. Default has occurred in the conditions of the Common Interest Community Number 120 a Condominium Savanna Oaks Coach Homes Declaration, Washington County, Minnesota, by Janet Vang, as fee owner of the below-described property subject to said Declarations. 

2. Pursuant to the Common Interest Community Number 120 a Condominium Savanna Oaks Coach Homes Declaration, filed in the Office of the County Recorder for Washington County on October 1, 1998 as Document No. 3005163, and all amendments thereto, and Minnesota Statutes, a statutory lien exists for unpaid assessments and fees incurred from March 1, 2017 to the date of this notice. 

3. A previous action was instituted to recover a portion of this debt in Court File No. 82-CV-17-4514. That action has been discontinued and an execution upon the judgment rendered therein has been returned unsatisfied in part. 

4. The holder of the lien has complied with all conditions precedent to acceleration of the debt secured by the assessment lien and foreclosure of said lien, and all notice and other requirements of applicable statutes. 

5. As of the date of this notice the amount due, after acceleration pursuant to the Association’s Declarations and By-laws, is $8,399.15. 

6. As of the date of this notice, the names of all parties that have been released from liability for the assessment lien are as follows: NONE.

TO THE RESPONDENTS HEREIN ABOVE NAMED: 

You, and each of you, are hereby notified that on the 2nd day of August, 2018, at 1:30 p.m., or as soon thereafter as counsel can be heard, before Judge Robyn A. Millenacker, in Room 1550 in the Courthouse at St. Paul, Ramsey County, Minnesota, the County of Ramsey as Petitioner will present to the above-named court a Petition now on file herein for condemnation of certain land for highway purposes. 

The object of the Petition is to acquire by “quick take” condemnation under the right of eminent domain the real property interests as described in the Petition. 

The land desired and proposed to be taken are situated in Ramsey County, Minnesota, and are described in the Petition, together with the names of all persons appearing of record or known to Petitioner to be the owners of said land or interested therein including all whom Petitioner has been able by investigation and inquiry to discover, together with the nature of the ownership of each as nearly as can be ascertained. 

At the hearing, the County of Ramsey will ask the Court for an order permitting payment to the respective owners or deposit with the Court an amount equal to Petitioner’s approved appraisal of value of the parcels described in the Petition, thereby transferring title and the right to possession of the property to the County of Ramsey effective August 30, 2018. Furthermore, the County of Ramsey will ask the Court to ascertain the allocation of funds so deposited and to establish a procedure for the withdrawal of those funds. Neither payment to the respective owners nor deposit with the Court shall prejudice or affect the right of a respective party to apply for additional payment in this proceeding. Finally, the County of Ramsey will ask the Court to establish procedures by which commissioners shall hear all allegations and proofs of persons interested herein. 

A party wishing to challenge the public use or public purpose, necessity, or authority for a taking must appear at the court hearing and state the objection or must appeal within 60 days of a court order, and a court order approving the public use or public purpose, necessity, and authority for the taking is final unless an appeal is brought within 60 days after service of the order on the party. Furthermore, a party wishing to be heard as to the appointment of the commissioners who will ascertain the amount of damages must appear at the court hearing. 

Any person not appearing at the hearing, or otherwise filing a notice of appearance with the district court, may not be notified of further hearings or actions related to the Petition.

IN THE MATTER OF THE CONDEMNATION OF CERTAIN LAND 

TO: THE DISTRICT COURT ABOVE NAMED 

The County of Ramsey brings this Petition and respectfully states and alleges: 

I. 

That this proceeding is taken pursuant to law in the name of and on behalf of the County of Ramsey, State of Minnesota, by John J. Choi, the duly elected, qualified and acting County Attorney, at the request of the Board of County Commissioners of Ramsey County, as shown by County Board Resolution No. B2017-039, dated February 14, 2017, a certified copy of which is attached hereto as Exhibit A and made a part hereof.

II. 

That the County of Ramsey also deems it necessary, expedient, and for a public use and purpose to obtain by “quick take” condemnation under the right of eminent domain the respective fee simple title, permanent easements and temporary construction and building removal easements in the lands as described in this Petition, together with all structures, trees, shrubs, grass and herbage to be damaged thereby. 

III. 

Where “fee title” is identified, the interests being conveyed is fee simple title.

IV. 

Where a “permanent easement” is identified, the interests being conveyed include all rights necessary for the construction, operation, and maintenance of all public right-of-way and utility uses now known or adopted in the future. Such rights include, but are not limited to: to remove and use all plants, trees, ground cover, and natural growth now existing, or later planted or grown; to permanently grade or alter the grade of the land, and to remove and use all earth and other material not reasonable necessary for lateral and subjacent support; to limit or allow all rights of access to the public right-of-way from the adjoining land; to store equipment or supplies; to access, both ingress and egress, from reasonably convenient rights-of-way; to remove any physical improvements or fixtures; and to exclude from the area any use or improvement that conflicts with the rights conveyed herein.

V. 

Where a “temporary easement” is identified, the interests being conveyed include all rights of possession and use, for a limited period of time, necessary or incidental to support the related construction project, including the right: to store equipment or supplies (except hazardous waste); to stage equipment or supplies; to access other portions of the construction project; to permanently grade or alter grade of the land; to remove (and restore in substantially similar condition) any plants, ground cover, or physical improvements; to access, both ingress and egress, from reasonably convenient rights-of-way; and to install any temporary improvements. The term of the temporary easement shall be for 24 months beginning on November 1, 2018, plus two options whereby the Petitioner may elect to extend the term of the temporary easement for six-months each. The election will be made 30 days prior to expiration of then current term upon remittance of a payment as identified in the Petitioner’s appraisal of damages.

VI. 

Where “Access Rights” is identified, the interests being conveyed include all rights of ingress and egress by any highway use from the remainder of the subject to the right-of-way identified.

VII. 

Where a “temporary building removal easement” is identified, the interests being conveyed include all rights of possession and use, for a limited period of time, necessary or incidental to remove all physical improvements, including the right: to store equipment or supplies (except hazardous waste); to permanently grade or alter grade of the land; to remove any plants or ground cover; to access, both ingress and egress, from reasonably convenient rights-of-way; and to install any temporary improvements. The term of the temporary building removal easement shall be from May 1, 2019 to June 29, 2019.

VIII. 

Personal property not specifically identified as being acquired, including, but not limited to, fencing, irrigation systems, pavement, curbing, or signage, or trees, shrubs, plants, or ground covering, is not included in this petition, except to the extent the above rights provide for the removal, replacement, use, or repair of such property. It is the intention of the Petitioner to address any claim of damage related to personal property destroyed, removed, lost, or otherwise damaged, but not repaired or replaced in substantially similar condition, in accordance with applicable relocation laws, including Minn. Stat. § 117.50 - .56 or the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970, as amended, and any regulations adopted pursuant thereto. 

IX. 

That the purpose for which said interests in land described in this Petition are being acquired is for the widening, addition to and realignment of Rice Street at Highway 694 for the purpose of public travel and transportation and related uses.

X. 

The taking in this matter is to obtain rights sufficient to support the construction and maintenance of a public highway, including related facilities. Pre-existing utility and other easements or interests which do not interfere with the interests being acquired or the right of the County of Ramsey to construct and maintain a public highway on the land being acquired will remain in full force and effect. If any parcel being taken by this condemnation proceeding is subject to a pre-existing utility or other easement or interest, the County of Ramsey will work as needed with the easement holder to adjust facilities to accommodate the construction or to adjust construction plans to reduce related damages.

XI. 

It is the intent of the Petitioner that reasonable access, in at least one direction, to the main thoroughfare will be maintained for any remaining interest of a property from which a permanent or temporary easement is taken.

XII. 

Notwithstanding anything to the contrary contained herein, should tests or evaluations undertaken by or on behalf of the County of Ramsey indicate the possible presence of pollutants, contaminants, or hazardous substances on any of the property described in this Petition, the County of Ramsey reserves the right to defer effecting the transfer of the interest to any of the property as described herein for a reasonable time until the County of Ramsey can evaluate whether it wishes to proceed with the taking, abandon these proceedings and dismiss the Petition as to said property, or otherwise respond to such information. 

Further, the County of Ramsey reserves the right to recover costs of clean-up and testing and all other damages resulting from the presence of pollutants, contaminates, or hazardous substances on the property described herein, from all potentially responsible parties in a separate legal action.

XIII. 

That a party wishing to challenge the public use or public purpose, necessity, or authority for a taking must appear at the hearing of this Court at which the County of Ramsey, as Petitioner, shall present this Petition to the Court and state the objection or must appeal within 60 days of a Court order.

XIV. 

That the land in these proceedings to be taken are situated in Ramsey County, Minnesota and are more particularly described in attached Exhibit B which is made a part hereof. The names of all persons appearing of record or known to the County of Ramsey to be the owners of said land, or interested therein, including all whom the County of Ramsey has been able by investigation and inquiry to discover, together with the nature of the ownership of each, as nearly as can be ascertained, are set forth on attached Exhibit B.

XV. 

The County of Ramsey hereby moves the court for an order transferring title and possession of the parcels described herein prior to filing of an award by the court appointed commissioners, pursuant to Minnesota Statutes § 117.042. 

WHEREFORE, the County of Ramsey prays for an order of this Court as follows: 

1. Adjudging that said taking is for a public purpose, is necessary, and is authorized by law; and 

2. It be further adjudged that the County of Ramsey is entitled to take and hold such property for the public use pursuant to the Notice of Intent to Take Possession, on file with this Court; and 

3. Appointing three disinterested commissioners, and at least two alternates, to ascertain and report the amount of damages that will be sustained by the several owners on account of the taking; fixing the time and place of the first meeting of the three commissioners; prescribing their compensation; establishing procedures for the disbursement of funds deposited with the district court; establishing procedures by which commissioners shall hear all allegations and proofs of persons interested herein; and requiring the commissioners to file their report with the District Court Administrator within 180 days from the date of the order appointing the commissioners unless said time be further extended by order of the Court; and 

4. For such other and further relief as may be proper and pursuant to law.

NOTICE OF HEARING ON PROPOSED ASSESSMENT

EAGLE POINT BLVD – STREET IMPROVEMENTS 

Notice is hereby given that the City Council of Lake Elmo will meet in the council chambers of the city hall at or approximately after 7:00 P.M. on Tuesday, July 17, 2018, to consider, and possibly adopt, the proposed assessment against benefitting property for the Eagle Point Boulevard Street Improvements. Adoption by the Council of the proposed assessment may occur at the hearing. The following describes the area proposed to be assessed: 

• Street improvements completed along Eagle Point Boulevard from Inwood Avenue to Hudson Boulevard and consisted of the reconstruction of the existing street with a sand subbase, draintile, new concrete curb and gutter and extension of the existing storm sewer system. 

You may at any time prior to certification of the assessment to the county auditor pay the entire assessment on such property to the City Clerk with interest accrued to the date of payment. No interest shall be charged if the entire assessment is paid to the City Clerk within 30 days from the adoption of this assessment. You may at any time thereafter, pay to the City Clerk the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made. Such payment must be made before November 15 or interest will be charged through December 31 of the succeeding year. If you decide not to prepay the assessment before the date given above the rate of interest that will apply is 4.30 percent per year. 

Once assessments are certified to the County, the assessments are payable in equal annual installments extending over a period of 10 years for street improvements, the first of the installments to be payable on or before the first Monday in January 2019, and will bear interest at the rate of 4.30 percent per annum from the date of adoption of the assessment resolution. To the first installment shall be added interest on the entire assessment from the date of the assessment resolution until December 31, 2018. To each subsequent installment when due shall be added interest for one year on all unpaid installments. 

The proposed assessment roll is on file for public inspection at the City Clerk’s office. The total amount of the proposed street improvement assessments is $1,182,900. Written or oral objections will be considered at the meeting. No appeal may be taken as to the amount of an assessment unless a written objection signed by the affected property owner is filed with the municipal clerk prior to the assessment hearing or presented to the presiding officer at the hearing. The Council may upon such notice consider any objection to the amount of a proposed individual assessment at an adjourned meeting upon such further notice to the affected property owners as it deems advisable. 

An owner may appeal an assessment to district court pursuant to Minnesota Statutes, Section 429.081 by serving notice of the appeal upon the Mayor or Clerk within 30 days after the adoption of the assessment and filing such notice with the district court within ten days after service upon the Mayor or Clerk. 

The City Council may, in its discretion, defer the payment of this assessment for any homestead property owned by a person for whom it would be a hardship to make payment if the owner is 65 years of age or older and/or the owner is a person retired by virtue of a permanent and total disability or by a person who is a member of the Minnesota National Guard or other military reserves who is ordered into active military service, as defined in section 190.05 subdivision 5b or 5c, as stated in the person’s military orders. The owner must request a deferment of the assessment at or before the public hearing at which the assessment is adopted and make application on forms prescribed by the City Clerk within 30 days after the adoption. 

Notwithstanding the standards and guidelines established by the City for determining a hardship, a deferment of an assessment may be obtained pursuant to Minnesota Statutes Section 435.193.

Pursuant to Minn. Stat. § 375.51, subd. 3, a summary of the proceedings of the Washington County Board of Commissioners to adopt Resolution No. 2018-054 are hereby published in accordance with Minn. Stat. § 331A.01 . 

Pursuant to Minn. Stat. Chapter 394, Washington County has adopted official controls for the purposes of regulating the physical development of land in the unincorporated areas of the County. These official controls are compiled into and referred to as the Washington County Development Code. 

On April 24, 2018, the Washington County Planning Advisory Commission (PAC) held a public hearing and made a recommendation to the Washington County Board to: 1) repeal the existing forty (43) zoning/land use ordinances 2) adoption of ten (10) new zoning/land use ordinances and 3) repeal the existing Washington County Development Code and adopt a revised Washington County Development Code. 

On June 5, 2018, the Washington County Board of Commissioners adopted Resolution No. 2018-054: Repeal of Current Zoning/Land Use Ordinances and Adoption of New Zoning Land Use Ordinances and Repeal of Existing Development Code and Adoption of the revised Development Code; Zoning Land Use Ordinance Numbers 203, 204, 205, 206, 207, 208, 209, 210, 211 & 212. 

A brief summary of the Washington County Development Code is as follows: 

Chapter One, Administration (Ordinance No. 203) 

With the exception of Subsurface Sewage Treatment System Regulations and Buffer Regulations, which are applicable in all portions of the County, the County’s land use authority is limited to the following areas within the unincorporated areas of the County, and include the following: 

(1) Subdivision of land in areas that are subject to Chapter Three. 

(2) Subsurface Sewage Treatment Systems. 

(3) St. Croix River Management Overlay District. 

(4) Shoreland Management Overlay District. 

(5) Mining operations. 

(6) Riparian Vegetative Buffers. 

(7) Floodplains. 

(8) Official Map areas. 

Sections 1, 2, and 3 address the Purpose and Intent of the Administration ordinance, provides more clarification of Definitions and Rules of Interpretation. Section 6 and 7 describes the role of the Zoning Administrator, the process for Appeals and Variances through the Board of Adjustment and Appeals, a quasi-judicial body with established board membership and meetings, administrative appeals, variances, official map and judicial appeals. Section 7 and 8 describes the duties of the Plat Commission and Planning Advisory Commission membership and meetings. Section 9 describes Conditional Uses through the application, notice and hearing procedure, criteria for granting a conditional use permit, compliance, length of a conditional use permit, expiration of a conditional use permit, revocation, records of conditional uses, amended conditional use permits and reapplication. Section 10 describes the process for obtaining a Certificate of Compliance including an application, compliance, issue and conditions and record. Chapter Two, Zoning Regulations (Ordinance No. 204) 

The performance standards established in this chapter apply within the unincorporated areas of the County to the functions, areas and overlay districts identified. The standards are designed to prevent and eliminate those conditions which cause blight and to assure that neighboring land uses are compatible. All future development in any district subject to the Development Code is required to meet these standards which also apply to existing development where so stated. 

Chapter Two Part 1 Zoning Overlay Districts Maps and Descriptions are the official maps. Part 2 Performance Standards Section 1 and 2 are the Development Standards and Standard for Uses. Section 3 refers to The St. Croix River Management Overlay District and the Shoreland Management Overlay District. Section 4 are the Open Space Development regulations. Section 5 and 6 include Separability and Effective date. 

Chapter Three, Subdivision Regulations (Ordinance No. 205) 

Section 1 Intent and Purpose of this chapter details the process for dividing undeveloped land into home sites, or separate parcels for other uses, and is one of the most important factors in the growth of any township. In most subdivisions, roads and streets must be maintained and various public services must be provided. It is in the interest of the general public, the developer, and future owners that subdivisions be conceived, designed, and developed in accordance with sound rules and proper standards. (1) Designate suitable land use districts along the bluffland and shoreland of the Lower St Croix River. 

(2) Regulate the area of a lot, and the length of bluffland and water frontage suitable for building sites. 

(3) Regulate the setback of structures and sanitary waste treatment facilities from blufflines to protect the existing and/or natural scenic values, vegetation, soils, water, and bedrock from disruption by man-made structures or facilities. 

(4) Regulate the setback of structures and sanitary waste treatment facilities from shorelines to protect the natural scenic value, floodplain, and water quality. 

(5) Regulate alterations of the natural vegetation and topography.

Chapter Seven, Mining Regulations (Ordinance No. 209) 

Section 1, Intent and Purpose is to: 

(1) Provide for the economic availability and removal of sand, gravel, rock, soil and other materials vital to the continued growth of Washington County. 

(2) Establish regulations, safeguards and controls in the unincorporated areas of the County regarding noise, dust, traffic, drainage, groundwater quality and other factors which will minimize the environmental and aesthetic impacts on mined or adjacent property. 

(3) Reduce the potential for pollution caused by wind, soil erosion and sedimentation. 

(4) Establish locations, orderly approval process and operating conditions under which mining operations will be allowed in the unincorporated areas of the County and to establish conditions which ensure the restoration of mined areas consistent with the existing and planned land use patterns. 

(5) Ensure compliance with the regulations established in this Ordinance on those mining operations presently operating in Washington County. 

(6) Distinguish between operations operating with a permit prior to the effective date of this Ordinance and operators who do not have a permit prior to the effective date of this Ordinance.

Chapter Eight: Buffer Regulations (Ordinance No. 210) 

This chapter was adopted on October 24, 2017 as Ordinance 201 and became effective November 8, 2017 on and incorporated into this revised Chapter Eight of Washington County Code. 

Section 1.1 Purpose and Authority is adopted pursuant to the authorization and policies contained in Minn Stat. §103F.48, the Buffer Law, and is to: 

(1) Provide for riparian vegetated buffers and water quality practices to achieve the following purposes: 

A) Protect state water resources from erosion and runoff pollution; 

B) Stabilize soils, shores and banks; and 

C) Protect or provide riparian corridors. 

(2) Coordinate the implementation and enforcement of the water resources riparian protection requirements of Minn. Stat. §103F.48 with the shoreland management rules and ordinances adopted under the authority of Minn. Stat. §103F.201 to 103F.227 and the management of public drainage systems established under Minn. Stat. chapter 103E where applicable; and 

(3) Provide efficient and effective direction to landowners and protection of surface water quality and related land resources. 

Section 2 and 3 is the Scope and Definitions in the ordinance. Section 4 and 5 describes Data Sharing/Management and Jurisdiction. Section 5 and 6 are the Buffer Requirements

Chapter Nine: Floodplain Management Regulations (Ordinance No. 211) 

Purpose and Intent is to regulate flood hazard areas within unincorporated areas of the County, which are subject to periodic inundation causing hazard to life and property, disruption of commerce and governmental services, unsanitary conditions, interruption of transportation and communication, extraordinary public expenditures for flood protection and relief and impairment of the tax base – all of which adversely affect the public health, safety and general welfare of the residents of Washington County. Based on these intentions, the purpose of these regulations are to: 

(1) Protect the public health, safety, and general welfare. 

(2) Conserve and enhance natural resources, and maintain a high standard of environmental quality. 

(3) Preserve the capacity of floodplains to carry and discharge regional floods. 

(4) Preserve and enhance the quality of surface waters. 

(5) Regulate the placement of sanitary and waste disposal facilities on lots. 

(6) Regulate the placement of structures and facilities in flood prone areas. 

(7) Be consistent with the Federal Emergency Management Agency (FEMA) rules codified as 44 Code of Federal Regulations, Parts 59-78, as amended by participating and maintaining eligibility in the National Flood Insurance Program. 

(8) Guide development, not prohibit it. 

Sections 2, 3 and 4 are Scope and Applicability, Definitions and Administration. Sections 5, 6, 7 and 8 are Establishment of the Floodplain District, Floodway and General Floodplain Uses and Utilities, Railroads, Roads and Bridges in the Floodplain District and Standards for General Floodplain (Flood Fringe) Primary Uses and Conditional Uses. Section 9 is the Floodplain Evaluation allowed under the Ordinance and Review by the Minnesota DNR. Section 10 and 11 and 12 are Subdivision and Conditional Use and Variance requirements and process. Section 13, 14 and 15 address Nonconformities, Enforcement and Amendments. Section 16 is the Effective Date

Chapter Ten: Official Map and Regulation and Designation (Ordinance No. 212) 

Section 1 Purpose and Authority is:

Land that is needed for future street and highway purposes and as sites for other necessary public facilities, including public facilities such as: parks, playgrounds, schools and other public buildings, civic centers, and travel service facilities frequently used for non-public purposes which could have been located on other lands without hardship or inconvenience to the owners. When this happens, future public use of that land may be denied or may be obtained only at prohibitive costs or at the expense of dislocating the owners and occupants of the land. Identification on an Official Map of land needed for future public uses allows both the public and private property owners to adjust their building plans equitably and conveniently before investments are made which will make such adjustments difficult to accomplish. It is the purpose of this Ordinance to establish a uniform procedure for the proper use of Official Maps as authorized by Minnesota Statutes §394.21 to §394.37. 

Section 2 Official Map Defined is the map adopted in accordance with the ordinance. Section 3, Initiation of Proceedings is the actions taken for adoption, amendment or repeal of an official map. Section 4 is Maps and Reports required for actions on the Official Map. WHEREAS, Washington County is authorized to carry on County planning and zoning activities in the unincorporated areas of the County pursuant to Minn. Stat. Chapt. 394; and 

WHEREAS, the Washington County Comprehensive Plan was adopted by the Washington County Board of Commissioners on April 22, 1997 and became effective October 1, 1997 as Washington County Ordinance No. 124, amended on September 7, 2010 to the Washington County Comprehensive Plan 2030 as Washington County Ordinance No. 184, and amended on August 16, 2016 as Washington County Ordinance 198; and 

WHEREAS, pursuant to Minn. Stat. 473.865 the Washington County Comprehensive Plan is the implement by which the County’s regulation of land use is devolved through adoption of official controls under Chapter 394. 

WHEREAS, the current official controls as reflected in the Washington County Development Code were adopted by the Washington County Board of Commissioners and became effective on October 20, 1997 as Washington County Ordinance No. 127; and 

WHEREAS, all the townships in Washington County have assumed regulatory control of land use through adoption of the Comprehensive Land Use Plans under the 2030 Regional Development Framework pursuant to the authority contained in Minn. Stat. 473.861 and the County’s relinquishment of such controls; and 

WHEREAS, such transformation has been found by the Metropolitan Council to conform to the regional system plans for transportation, water, resources management and parks; and 

WHEREAS, the Township’s plans are consistent with the Washington County 2030 Comprehensive Plan and are compatible with the plans of adjacent and affected jurisdictions; and 

WHEREAS, the recasting of the County’s official controls necessitate revision of the Washington County Development Code; and 

WHEREAS, the forty-three (43) current zoning/land use ordinances, attached as Exhibit A, are determined to be anachronistic and must be repealed; and 

WHEREAS, ten (10) new zoning/land use ordinances, attached as Exhibit B, must be enacted; and

WHEREAS, the records of the public hearing consists of the minutes of both the Washington County Board of Commissioners and the Planning Advisory Commission meetings, staff reports, a presentation by the Washington County Public Works Department, and comments from members of the public. 

NOW, THEREFORE IT BE RESOLVED, that the Washington County Board of Commissioners hereby adopts the findings and recommendations of the Washington County Planning Advisory Commission. 

BE IT FURTHER RESOLVED, based upon the hearing record, the Washington County Board of Commissioners hereby repeals the existing forty-three (43) zoning/land use ordinances attached and incorporated herein as Exhibit A.
