To the District Court above named the State of Minnesota brings this Petition and respectfully states and alleges:

That Trunk Highway Legislative Route numbered 102, which has been renumbered 140, and which has been located according to law and passes over the lands herein described. 

That it is duly covered by Right of Way Plat Order numbered 97060. 

That it is duly covered by Temporary Trunk Highway Order No. 8488 and Supplemental Temporary Trunk Highway Slope Order No. 97078.

II. 

That the Commissioner of Transportation deems it necessary that the State of Minnesota for trunk highway purposes obtain an easement in the lands herein described, together with the following rights: to acquire all trees, shrubs, grass and herbage within the right of way herein to be taken, and to keep and have the exclusive control of the same; and to acquire a temporary easement in those cases which are herein particularly mentioned. 

It is the intention of the above-named petitioner to move the court for an order authorizing the Court Administrator to accept and deposit in an interest bearing account payments from the petitioner to the court pursuant to Minnesota statutes. 

Further, it is the intention of the above-named petitioner to move the court for an order transferring title and possession of the parcels herein described, prior to the filing of an award by the court appointed commissioners, pursuant to Minnesota Statutes §117.042. 

The petitioner reserves its right to recover costs of clean up and testing and all other damages arising from the presence of pollutants, contaminants, or hazardous materials on the property described herein, from all potential responsible parties, including respondents herein where appropriate, in a separate legal action to the extent permitted by law.

NOTICE OF ASSESSMENT HEARING 

NOTICE IS HEREBY GIVEN that the City Council of Maplewood, Minnesota, will meet in the council chambers of the Maplewood Municipal Building, 1830 County Road B East, Maplewood, Minnesota at 7:00 p.m. on Monday, May 14, 2018 to hear all persons concerning the adoption of the assessment roll for Public Improvement Project 17-19, Londin-Highpoint Area Street Improvements and to adopt the assessment roll as presented or amended. This hearing is scheduled pursuant to Minnesota Statutes Chapter 429. The assessment roll as herein described is on file in the office of the city clerk. Questions regarding the assessment roll may be addressed to the office of the city engineer. The total amount to be assessed is $468,858.45. 

The general nature of the proposed improvements include a full depth pavement reclamation of neighborhood streets, milling of Londin Lane, new pavement installation, spot curb replacement, and spot utility repairs. This project includes those properties abutting: 

Crestview Drive from Londin Lane to Mailand Road, Highpoint Curve from Crestview Drive to Mailand Road, King Avenue from Crestview Drive to Highpoint Curve, Londin Lane from McKnight Road to Lower Afton Road, Marnie Street from King Avenue to Pond Avenue, Pond Avenue from Crestview Drive to Marnie Street 

Persons who wish to be heard or to object with reference to this matter may present their cases at this hearing, either orally or in writing. No appeal may be taken as to the amount of any assessment adopted unless a written objection signed by the property owner is filed with the city clerk prior to the assessment hearing or presented to the presiding officer at the hearing. 

An owner may appeal an assessment to district court pursuant to M.A. Section 429.081 by serving notice of the appeal upon the mayor or city clerk of the City of Maplewood within thirty (30) days after the adoption of the assessment and by filing such notice with the district court within ten (10) days after service upon the mayor and city clerk. 

Under provisions of Minnesota Statutes Section 435.193 to 435.195 the city may, at its discretion, defer the payment of assessments for homestead property owned by a person not less than 65 years of age or homestead properties for persons retired by virtue of a certified permanent and total disability for whom it would be a hardship to make the payments. The council may also defer any homestead underdeveloped or undeveloped properties for which it would be a financial hardship to pay the assessment. The procedures for applying for such deferment are available from the office of the city engineer. 

The following information shall also apply: 

1. The property owner shall have the right to prepay the entire assessment. Your assessment, or any portion thereof, may be paid without interest from May 15, 2018 through June 13, 2018 to the City of Maplewood at the Department of Public Works, 1902 County Road B East, Maplewood, Minnesota. 

2. Partial prepayment of the assessment has been authorized by ordinance. Partial payment, if made, should be a minimum of 25% of the levied assessment amount. 

3. The rate of interest to be accrued, if the assessment is not prepaid within the required time period, is proposed to be 5.0% (final interest rate determined at time of bond sale) commencing on the date of adoption by the city council and running for 8 calendar years for commercial properties and 15 calendar years for residential properties. 

4. The amount to be specially assessed against your property is shown on the attached public improvement Statement of Assessment.

TEN-YEAR FACILITY PLAN AND CERTAIN OTHER CAPITAL PROJECTS

INDEPENDENT SCHOOL DISTRICT NO. 622

(NORTH ST. PAUL-MAPLEWOOD-OAKDALE)

STATE OF MINNESOTA 

NOTICE IS HEREBY GIVEN that the School Board of Independent School District No. 622 (North St. Paul-Maplewood-Oakdale), State of Minnesota (the “District”), adopted a resolution on April 24, 2018 (the “Resolution”) stating the intention of the School Board to issue general obligation bonds (the “Bonds”) in the total principal amount of not to exceed $55,000,000 pursuant to Minnesota Statutes, Sections 123B.595 and 123B.62, and Chapter 475, as amended. 

A portion of the proceeds of the Bonds (the “Facilities Maintenance Portion”) in the principal amount of not to exceed $45,000,000 will be used to fund the costs of the following projects to be included in the District’s facility plan and related financing costs: 

• deferred maintenance and health and safety projects at school sites and facilities as included in the District’s ten-year facility plan to be approved by the Commissioner of Education. 

A portion of the proceeds of the Bonds (the “Capital Facilities Portion”) in the principal amount of not to exceed $10,000,000 will be used to fund the costs of the following capital improvements to be approved by the School Board and related financing costs, subject to the approval of the Commissioner of Education: 

• improvements and repairs to District buildings and sites; 

• equipping and reequipping buildings with permanent attached fixtures; 

• acquisition of furniture, fixtures and equipment; 

• fire, life and safety code compliance projects; and 

• facility improvements to enhance safety and security. 

Pursuant to Minnesota Statutes, Section 123B.62, as amended, the Bonds will be finally authorized for issuance, subject to the approval of the Commissioner of Education, unless a petition calling for a referendum on the question of whether to issue said Capital Facilities Portion, signed by more than fifteen percent (15%) of the registered voters of the District, is filed with the School Board within thirty (30) days of the date of the School Board’s adoption of the Resolution. A petition must be in the form required by law. The minimum number of valid signatures for such a petition shall be determined as of the last day before the petition is filed with the School Board. 

The total amount of outstanding indebtedness of the District as of April 30, 2018 is $81,155,000. If the proposed Bonds are issued, the total indebtedness of the District would be $136,155,000.

The Phase II National Pollutant Discharge Elimination Program (NPDES) requires the City to hold an annual public meeting. The meeting will be held as part of the regular Environmental and Natural Resources Commission meeting in the council chambers at City Hall. There will be a presentation of the city’s Surface Water Pollution Prevention Plan (SWPPP), and time will be set aside to solicit resident comments and input. Comments will be addressed, and may be incorporated into the city’s plan to preserve our water resources.

ON THE CITY STORM 

WATER POLLUTION PREVENTION PROGRAM 

Notice is hereby given that the City Council of Lake Elmo will meet at City Hall at 7:00 p.m. on Tuesday, June 5, 2018, to conduct a public meeting to encourage public discussion and participation regarding its storm water quality and Storm Water Pollution Prevention Program (SWPPP). 

A 1987 Amendment to the Federal Clean Water Act required implementation of a two-phase comprehensive national program to reduce pollution from storm water runoff. A National Pollutant Discharge Elimination System (NPDES) permit from the Minnesota Pollution Control Agency (MPCA) is required as part of this program. The permit identifies a number of measures that must be met or implemented by each community. The six minimum measures are: 

• Public Education and Outreach 

• Public Involvement and Participation 

• Illicit Discharge Detection and Elimination 

• Construction Site Storm Water Controls 

• Post-Construction Storm Water Management for development and redevelopment 

• Pollution Prevention/Good Housekeeping for Municipal Operations 

The City’s Storm Water Pollution Prevention Program specifies best management practices intended to satisfy the permit requirements for each of the minimum measures. As part of this program, the City is required to hold an annual meeting to encourage public discussion and participation regarding its storm water quality and steps it is taking to address the six minimum control measures. A copy of the SWPPP is available on the City website or by contacting the City Engineer. An annual report will be submitted to the MPCA in June 2018. The minutes of the annual public meeting will be incorporated into the City’s annual report. 

The meeting will be held as part of the regular City Council Meeting at City Hall. The agenda for this meeting will include: 

1) A Presentation about implementation of the City’s Surface Water Pollution Prevention Program in 2017, 

2) Affording interested persons the opportunity to make oral statements concerning the Storm Water Pollution Prevention Program, 

3) Consideration of relevant written materials that interested persons submit concerning the Storm Water Pollution Prevention Program; and, 

4) Consideration of public input in making adjustments to the 2018 implementation plan for the Storm Water Pollution Prevention Program.
