NOTICE OF DEFAULT AND FORECLOSURE SALE 

WHEREAS, on May 21, 2003, a certain Mortgage was executed by Ruth L. Ellwanger, a single person, as mortgagor, in favor of Seattle Mortgage Company, as mortgagee, and was recorded on October 17, 2003, as Instrument No. 3688313 in the Office of the County Recorder, Ramsey County, Minnesota; and 

WHEREAS, the Mortgage was insured by the United States Secretary of Housing and Urban Development (the Secretary) pursuant to the National Housing Act for the purpose of providing single family housing; and 

WHEREAS, the Mortgage is now owned by the Secretary pursuant to an assignment dated August 4, 2016, and recorded on August 25, 2016, as Instrument Number A04621359, in the office of the County Recorder, Ramsey County, Minnesota; and 

WHEREAS, a default has been made in the covenants and conditions of the Mortgage in that the Property ceased to be the principal residence of a Borrower for reasons other than death and the Property is not the principal residence of at least one other Borrower; and 

WHEREAS, the entire amount delinquent as of July 15, 2018 is $237,288.77; and

The sale will be held at the Ramsey County Sheriff’s Office, Lowry Building / City Hall Annex, 25 West 4th Street, Suite 150, St. Paul, MN 55102. 

The Secretary of Housing and Urban Development will bid $201,969.74. 

There will be no proration of taxes, rents or other income or liabilities, except that the purchaser will pay, at or before closing, his prorata share of any real estate taxes that have been paid by the Secretary to the date of the foreclosure sale. 

When making their bids, all bidders except the Secretary must submit a deposit totaling $ 20,196.97[10% of the Secretary’s bid] in the form of a certified check or cashier’s check made out to the Secretary of HUD. A deposit need not accompany each oral bid. If the successful bid is oral, a deposit of $ 20,196.97 must be presented before the bidding is closed. The deposit is nonrefundable. The remainder of the purchase price must be delivered within 30 days of the sale or at such other time as the Secretary may determine for good cause shown, time being of the essence. This amount, like the bid deposits, must be delivered in the form of a certified or cashier’s check. If the Secretary is the highest bidder, he need not pay the bid amount in cash. The successful bidder will pay all conveying fees, all real estate and other taxes that are due on or after the delivery date of the remainder of the payment and all other costs associated with the transfer of title. At the conclusion of the sale, the deposits of the unsuccessful bidders will be returned to them. 

The Secretary may grant an extension of time within which to deliver the remainder of the payment. All extensions will be for 15-day increments for a fee of $500.00, paid in advance. The extension fee shall be in the form of a certified or cashier’s check made payable to the Secretary of HUD. If the high bidder closes the sale prior to the expiration of any extension period, the unused portion of the extension fee shall be applied toward the amount due. 

If the high bidder is unable to close the sale within the required period, or within any extensions of time granted by the Secretary, the high bidder may be required to forfeit the cash deposit or, at the election of the foreclosure commissioner after consultation with the HUD representative, will be liable to HUD for any costs incurred as a result of such failure. The Commissioner may, at the direction of the HUD representative, offer the property to the second highest bidder for an amount equal to the highest price offered by that bidder. 

There is no right of redemption, or right of possession based upon a right of redemption, in the mortgagor or others subsequent to a foreclosure completed pursuant to the Act. Therefore, the Foreclosure Commissioner will issue a Deed to the purchaser(s) upon receipt of the entire purchase price in accordance with the terms of the sale as provided herein. HUD does not guarantee that the property will be vacant. 

The scheduled foreclosure sale shall be cancelled or adjourned if it is established, by documented written application of the mortgagor to the Foreclosure Commissioner not less than 3 days before the date of sale, or otherwise, that the default or defaults upon which the foreclosure is based did not exist at the time of service of this notice of default and foreclosure sale, or all amounts due under the mortgage agreement are tendered to the Foreclosure Commissioner, in the form of a certified or cashier’s check payable to the Secretary of HUD, before public auction of the property is completed. 

The amount that must be paid if the mortgage is to be reinstated prior to the scheduled sale is $ N/A as of N/A, plus all other amounts that would be due under the mortgage agreement if payments under the mortgage had not been accelerated, advertising costs and postage expenses incurred in giving notice, mileage by the most reasonable road distance for posting notices and for the Foreclosure Commissioner’s attendance at the sale, reasonable and customary costs incurred for title and lien record searches, the necessary out-of-pocket costs incurred by the Foreclosure Commissioner for recording documents, a commission for the Foreclosure Commissioner, and all other costs incurred in connection with the foreclosure prior to reinstatement. 

Tender of payment by certified or cashier’s check or application for cancellation of the foreclosure sale shall be submitted to the address of the Foreclosure Commissioner provided below.

2018 STREET AND UTILITY IMPROVEMENT PROJECT

NOTICE OF HEARING ON PROPOSED ASSESSMENTS

Notice is hereby given that the council will meet in the Council Chambers of the City Hall, located at 2400 Margaret Street, North St. Paul, at 6:30 P.M. on Tuesday, October 2nd, 2018, to consider, and possibly adopt, the proposed assessment for improvements on Lake Boulevard from 19th Avenue East to Lydia Avenue/Joy Road; Poplar Avenue from Helen Street North to Swan Avenue East; Swan Avenue East from Lake Boulevard to Poplar Avenue; 19th Avenue East from Helen Street North to Century Avenue; Park Row from 19th Avenue East to 20th Avenue East; 20th Avenue East from Park Row to Century Avenue. The project improvement shall include street reconstruction and replacement of sanitary sewer and water public main lines, storm sewer improvements, sanitary sewer lining, trails/sidewalks, street lighting, and electric and other burying of overhead and underground utilities, pursuant to Minnesota Statutes, Section 429.011 to 429.111. Adoption by the council of the proposed assessment may occur at the hearing. 

The amount to be specially assessed against your particular lot, piece, or parcel of land is (shown in the attachment to this notice). NOTICE OF HEARING ON PROPOSED ASSESSMENTS

S.A.D. 18-02 

Notice is hereby given that the council will meet in the Council Chambers of the City Hall, located at 2400 Margaret Street, North St. Paul, at 6:30 P.M. on Tuesday, October 2nd, 2018, to consider, and possibly adopt, the proposed assessment for improvements on 11th Avenue East from McKnight Road to 1st Street, Castle Avenue from 1st Street to Helen Street, and 12th Avenue East from Helen Street to Margaret Street, and Helen Street North from 12th Avenue East to 17th Avenue East by pavement reclamation of the street and spot replacement of concrete curb and gutter and concrete sidewalk pursuant to Minnesota Statutes, Section 429.011 to 429.111. Adoption by the council of the proposed assessment may occur at the hearing. 

The amount to be specially assessed against your particular lot, piece, or parcel of land is (shown in the attachment to this notice). Such assessment is proposed to be payable in equal annual installments extending over a period of fifteen (15) years for single family residential property, and seven (7) years for commercial, institutional and multi-family properties, the first of the installments to be payable on or before the first Monday in January 2019, and will bear interest at the rate of 5.25 percent per annum from the date of the adoption of the assessment resolution. 

You may at any time prior to certification of the assessment to Ramsey County, pay the entire assessment on such property, with interest accrued to the date of payment, to the Finance Department. No interest shall be charged if the entire assessment is paid within thirty-eight (38) days from the adoption of this assessment. You may at any time thereafter, pay to Ramsey County the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made. Such payment must be made before November 15 or interest will be charged through December 31 of the succeeding year. If you decide not to prepay the assessment before the date given above the rate of interest that will apply is 5.25 percent.

OLD VILLAGE PHASE 3 STREET AND UTILITY IMPROVEMENTS 

Notice is hereby given that the City Council of Lake Elmo will meet in the Council Chambers of the City Hall at or approximately after 7:00 P.M. on Tuesday, October 2, 2018, to consider, and possibly adopt, the proposed assessment against abutting property for the Old Village Phase 3 Street and Utility Improvements. Adoption by the Council of the proposed assessment may occur at the hearing. The following describes the area proposed to be assessed: 

• Street, drainage, and sidewalk improvements along Laverne Avenue, from 39th Street North to CSAH 14. 

• Street and drainage improvements along 31st Street North, from CSAH 17 to the east end; Laverne Court North, from 31st Street North to south cul-de-sac; and Layton Court North, from 31st Street North to south cul-de-sac. 

• Sanitary sewer improvements to the Lake Elmo Elementary School, City Hall and the Westbrook Building (3825 Lake Elmo Avenue) as well as extending sanitary sewer along Laverne Avenue, from 39th Street North to CSAH 14; 31st Street North, from CSAH 17 to the east end; Laverne Court North, from 31st Street North to south cul-de-sac; and Layton Court North, from 31st Street North to south cul-de-sac. 

• Watermain improvements to the Westbrook Building (3825 Lake Elmo Avenue). 

You may at any time prior to certification of the assessment to the county auditor on November 15, 2018, pay the entire assessment on such property to the City Clerk with interest accrued to the date of payment. No interest shall be charged if the entire assessment is paid to the City Clerk within 30 days from the adoption of this assessment. You may at any time thereafter, pay to the City Clerk the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made. Such payment must be made before October 31 (date assessment certified to County Auditor) or interest will be charged through December 31 of the succeeding year. If you decide not to prepay the assessment before the date given above the rate of interest that will apply is 3.26 percent per year. 

Once assessments are certified to the County, the assessments are payable in equal annual installments extending over a period of 15 years for street and drainage improvements and 20 years for sanitary sewer improvements, the first of the installments to be payable on or before the first Monday in January 2019 and will bear interest at the rate of 3.26 percent per annum from the date of adoption of the assessment resolution. To the first installment shall be added interest on the entire assessment from the date of the assessment resolution until December 31, 2018. To each subsequent installment when due shall be added interest for one year on all unpaid installments. 

The proposed assessment roll is on file for public inspection at the City Clerk’s office. The total amount of the proposed street improvement assessment is $567,225. The total amount of the proposed sanitary sewer improvement assessment is $983,100. The total amount of the proposed watermain improvement assessment is $34,837. The City contribution for the overall improvement project is $890,838. Written or oral objections will be considered at the meeting. The City Council is authorized in its discretion to defer the payment of an assessment for any homestead property owned by a person for whom it would be a hardship to make payment if the owner is 65 years of age or older and/or the owner is a person retired by virtue of a permanent and total disability or by a person who is a member of the Minnesota National Guard or other military reserves who is ordered into active military service, as defined in section 190.05 subdivision 5b or 5c, as stated in the person’s military orders, for whom it would be a hardship to make the payments. The owner must request a deferment of the assessment at or before the public hearing at which the assessment is adopted and make application on forms prescribed by the City Clerk within 30 days after the adoption. 

Notwithstanding the standards and guidelines established by the City for determining a hardship, a deferment of an assessment may be obtained pursuant to Minnesota Statutes Section 435.193.
