NOTICE OF CONDOMINIUM ASSOCIATION LIEN FORECLOSURE SALE 

WHEREAS, default has been made in the terms and conditions of the Declaration for Fairway Village, a Condominium, Condominium Number 120 (henceforth the Declaration) dated May 18, 1994 and recorded in the office of the County Recorder in and for Dakota County, Minnesota on May 27, 1994 as Document No. 1219417, as amended by Document No. 1266722 which said Declaration covers the following described property situated in the County of Dakota and State of Minnesota, to-wit: 

Unit No. 116, Condominium No. 120, Fairway Village, according to the plat thereof on file or of record in the Office of the County Recorder in and for Dakota County, Minnesota.

WHEREAS, pursuant to said Declaration, there is claimed to be due and owing as of the date of this Notice by Scott Beebe as unit owner to Fairway Village Homeowners Association, Inc., the principal amount of Two Thousand Five Hundred Fifty-four Dollars and 50/100 ($2,554.50) for condominium assessments through December, 2018; and no action being now pending at law or otherwise to recover said debt or any part thereof, and; 

WHEREAS, pursuant to said Declaration, and the statute in such case made and provided, said debt creates a lien upon said premises in favor of Fairway Village Homeowners Association, Inc. 

NOW, THEREFORE, notice is hereby given that by virtue of the power of sale created by statute, said lien will be foreclosed by the sale of said premises with the hereditaments and appurtenances, which said sale will be made by the Sheriff of Dakota County, Minnesota at the Sheriff=s main office in the Dakota County Courthouse Civil Division, 1580 Highway 55 - lobby S-100, in the City of Hastings in said County on February 28, 2019 at 10:00 a.m., at public auction to the highest bidder, for cash, to pay the amount then due for said condominium assessments, together with the costs of foreclosure, including attorney=s fees as allowed by law. The time allowed by law for redemption by the unit owner, his personal representatives or assigns, is six (6) months from the date of said sale. 

TIME AND DATE TO VACATE PROPERTY: If the real estate is an owner-occupied single family dwelling, unless otherwise provided by law, the date on or before which the unit owners must vacate the property if the lien is not reinstated under section 580.30 or the property is not redeemed under section 580.23 is 11:59 p.m. on August 28, 2019. If the foregoing date is a Saturday, Sunday or legal holiday, then the date to vacate the property is the next business day at 11:59 p.m.

Independent School District 197 – West St. Paul – Mendota Heights – Eagan Area Schools, 1897 Delaware Avenue, Mendota Heights, MN 55118 requests sealed bids on the reconstruction of the Henry Sibley High School sports fields and stadium. 

The Work generally includes reconstruction of the football and soccer fields, bleachers and press box, running track, field events, tennis courts, and specifically includes the following: 

• Site demolition and removal of existing site elements for completion of the new work; 

• New earthwork, storm sewer, sanitary sewer, watermain, asphaltic pavement, concrete pavement, irrigation, resilient track surfacing, flag pole, field equipment, fencing, seeding, sodding, landscaping, site restoration and other related work; 

• Coordination with the Owner’s separate contracts for synthetic turf, stadium seating, press box, score boards, and stadium lighting, and; 

• An alternate for 3 tennis courts, including acrylic color coating, net posts and nets. 

The Project site area is approximately 12.5 acres. 

Bids shall be on a Stipulated Lump Sum basis. Segregated bids will not be accepted. 

Independent School District 197 will receive Bids until 2:00 PM Central Time on Thursday, January 10, 2019, at the District Office, front desk, at 1897 Delaware Avenue, Mendota Heights, MN 55118. Bids received after this time will not be accepted. Bids will be opened publicly and read aloud. 

Bids shall be addressed to the attention of:

A Prebid Conference will be held beginning promptly at 3:00 PM, Central Time on Friday, December 21, 2018, at the Henry Sibley High School, 1897 Delaware Avenue, Mendota Heights, MN, Room A236. 

Contract time, pre-construction activities and submittals work related to the Project may commence immediately after receipt of the executed Owner-Contractor Agreement. 

Project shall be Substantially Complete by August 16, 2019, and Final Completion shall be by August 30, 2019. 

Electronic versions of the Bidding Documents (Drawings, Project Manual and Addenda), are available by contacting the Owner’s Representative at the phone number above. The Owner’s Representative will provide the Bidders access to the cloud-based provider Procore Technologies, Inc. for access to the documents and provide the Bidders locations of builders’ exchanges holding documents for Bidders’ review. Bidders are responsible for periodic review of the cloud-based provider’s website for issued addenda. Bidders are responsible for any and all costs associated with the hard copy printing of the Bidding Documents for their use. 

For Bidding Requirements, refer to AIA Document A701 – Instruction to Bidders included in the Project Manual. 

A Bid Security in the form of a certified check, a cashier’s check or a Bid Bond in the amount of 5 percent of the Bid must accompany each Bid in accordance with the AIA Document A701 - Instructions to Bidders, Subparagraph 4.2.1. 

Owner may make investigations as deemed necessary to determine the ability and responsibility of a Bidder to perform the Work. A Bidder shall furnish to Owner such information and data for this purpose in accordance with the requirements in AIA Document A701 - Instructions to Bidders. 

Owner is requesting and performing investigations as deemed necessary to determine the ability and responsibility of the Excavation contractor/sub-contractor to perform the excavation Work. A potential Excavation contractor/sub-contractor shall furnish to the Civil engineer a completed Excavation Qualification Statement included with Section 00 43 00 for this purpose prior to submitting a Bid. 

Owner reserves the right to (1) accept Bidder’s Base Bid only, (2) accept any one or more of the listed Alternates, if any, in any order regardless of the order in which they are listed on the Bid Form, (3) reject all Bids, (4) award contract based on Owner’s investigation of Bidders, as well as acceptance of alternates, all of which Owner deems to be in his best interest, (5) waive informalities or minor irregularities in Bids and waive minor irregularities or discrepancies in the Bidding procedure.

PUBLIC NOTICE 

Notice is hereby given that the Planning Commission of Inver Grove Heights will meet on TUESDAY, JANUARY 15, 2019 at 7:00 p.m. in the City Council Chambers, located at 8150 Barbara Avenue, Inver Grove Heights, MN to consider the request for HONSA SURVEYING - CASE NO. 18-61VAC. The purpose of this report is to provide summary 2019 budget information concerning the City of Inver Grove Heights to interested citizens. The budget is published in accordance with MN Statute 471.6965. This budget is a summary document only; the complete budget may be examined at the Finance Director’s Office in City Hall at 8150 Barbara Avenue, Inver Grove Heights, MN 55077 during normal business hours from 8:00 a.m. until 4:30 p.m., Monday through Friday.The City Council adopted this budget on December 10, 2018.

SCHOOL BOARD MEETING AND WORK SESSION 

A school board meeting and work session were held at 5:00 p.m. on Monday, December 17, 2018 at Henry Sibley High School, Room A-241, 1897 Delaware Avenue, Mendota Heights, MN. The following board members were present: John Chandler, Brenda Corbett, Stephanie Levine, Joanne Mansur, Maureen Ramirez, and Byron Schwab. Board member Terry Stamman was absent. Superintendent Peter Olson-Skog was present. Student Representative Sonja Hanson was present. 

Motions carried to approve the agenda and consent agenda. The consent agenda included minutes from the December 3 and 10, 2018 meetings; personnel recommendations; administrative reviews of policies 210, 213, 214, 410, 514, 524 and 711; resolution to designate identified official with authority for the MDE external user access recertification system; and gifts to the district. 

The FY 2017-2018 audit was presented. 

A work session followed. ORDINANCE NO. 2018-008

AN ORDINANCE AMENDING THE CITY CODE TO CLARIFY NUISANCE VEHICLES 

IN THE CITY 

THE CITY COUNCIL OF THE CITY OF LANDFALL VILLAGE DOES ORDAIN: 

That The City of Landfall Village Municipal Code, § 710.06, is hereby amended, striking certain text and amending with additional language, to reflect the City’s policy on nuisance vehicles and their disposition. 

Sec. 710.06 Certain Vehicles Declared a Public Nuisance. Any vehicle, whether occupied or not, that is found stopped, standing, or parked in violation of this Section or that is reported stolen or found impeding fire fighting, snow removal, or other street maintenance operations or the orderly flow of traffic, or any junk or abandoned, that has remained for a period of 48 hours on public property illegally, or has remained for a period of 14 days on private property including designated off street parking areas unless housed in a garage or storage building, or is otherwise an unauthorized vehicle in violation of any other Ordinance, Rule or Statute, e.g., in violation of 710.09, shall be hereby declared to be public nuisance and the public nuisance may be abated in the manner set forth in this Section. 

Any City Official or Peace Officer of proper jurisdiction, firefighter, or other duly authorized personnel, may order the nuisance vehicle to be immediately removed and impounded in the manner provided for in this Section. The vehicle shall be surrendered only to the duly identified owner thereof or his or her authorized agent upon payment of the fees provided in this Section which shall be declared to be the vehicle towing and impound fees covering the vehicle. 

The impounding of a vehicle pursuant to this Section shall not prevent or preclude the institution and prosecution of proceedings for violation of any provision of this Code, ordinance of the City, or State law, in the District Court or elsewhere, against the owner or operator of the impounded vehicle.

NOTICE OF PUBLIC HEARING

Notice is hereby given that the Lake Elmo Planning Commission will be holding a Public Hearing on Monday, January 14, 2019 at 7:00 p.m. in the City Council chambers at Lake Elmo City Hall (3800 Laverne Ave. N., Lake Elmo, MN 55042) regarding: 

COMPREHENSIVE PLAN 2040 UPDATE. The City of Lake Elmo Planning Commission is will be reviewing and making a recommendation about the updated DRAFT 2040 Comprehensive Plan. 

Why This Notice? Before adoption of the 2040 Comprehensive Plan, Minnesota Statute requires the City to hold a public hearing. The City Council held public hearings about the proposed 2040 Comprehensive Plan update in May 2018. Since that time, the city distributed the draft 2040 Comprehensive Plan to adjacent jurisdictions and other government agencies as required by State Law for their review and comment. The City has made minor changes to the draft 2040 Comprehensive Plan to reflect many of those comments and suggestions. 

The Planning Commission will hold a public hearing on the updated Draft 2040 Comprehensive Plan, take comments about the proposed 2040 Comprehensive Plan and will be making a recommendation about the proposed 2040 Comprehensive Plan to the Lake Elmo City Council. The City Council makes the final decision about adopting and approving the proposed 2040 Comprehensive Plan for the City. 

If you are unable to attend the Public Hearing but want to provide input, written comments are welcome and may be emailed to kroberts@lakeelmo.org or mailed to City Hall (3880 Laverne Ave N Ste. 100, Lake Elmo, MN 55042). Plans and materials are available for review at City Hall by appointment.

CITY OF MAPLEWOOD PUBLIC HEARING NOTICE 

What is Being Requested? 

Joshua Burrs on behalf of “The Car Buying Center” is proposing to repurpose the building at 1955 County Road D East into a used car dealership. The applicant proposes to repaint the internal and external of the building, restripe the parking lot and update the lighting throughout the building. There are no proposed changes to the size of the building. The applicant proposes to have 26 vehicles on display outside of the building and utilize the garage for the storage of vehicles. To move forward with this project, the applicant needs city council approval of a conditional use permit. 

Public Hearing Information 

The Maplewood Planning Commission will hold a public hearing for this proposal on Tuesday, 

January 15, 2019, at 7:00 p.m. or later. This meeting will be held at Maplewood City Hall, 1830 County Road B East in the City Council Chambers. All interested parties may appear at the hearing and present their views orally or submit written comments before the meeting. Sign language interpreters are available. You must request this service at least four days in advance. Call the city clerk at (651) 249-2002 to arrange this service. Assisted Listening Devices are also available. Check with the city clerk for availability. 

Why This Notice? 

City code requires that the Planning Commission hold a public hearing when considering conditional use permits. The Planning Commission will review and make a recommendation regarding this proposal. The City Council will make the final decision.

CITY OF NORTH ST. PAUL 

ORDINANCE NO. 778

AN ORDINANCE ADOPTING

THE 2019 REVISED MUNICIPAL FEE SCHEDULE AND UTILITY RATE SCHEDULE

AND RESCINDING ORDINANCE NO. 774 

SECTION I. Establishment. The City Council shall establish a fee and rate schedule for the various permits, licenses and services provided by the City of North St. Paul. Said schedule shall be reviewed by the City Manager from time to time to assure its appropriateness. In doing so, the City Manager shall consider the cost of labor and materials in providing the license, permit or service and any other factors deemed appropriate. It shall be the intent to recover all costs when establishing the fee and rate. 

SECTION II. Schedule. Fees and charges for services for license, permits, applications and utilities shall be located in City Hall, and may be amended from time to time. 

SECTION III. Effect. The schedule shall become effective upon the approval of the City Council. The City Clerk is hereby directed to publish this ordinance as required by law.

pursuant to Minnesota Statutes, Section 429.011 to 429.111. The area proposed to be assessed for such improvements includes those properties in Sections 8, Range 21 West, Township 29 North, abutting the streets noted above, all within City of Oakdale, Washington County, Minnesota. The project has an estimated total project cost of $2,748,000. A reasonable estimate of the impact of the assessment will be available at the hearing. Such persons as desire to be heard with reference to the proposed improvement will be heard at this meeting. 

PROPOSED ASSESSMENT. The proposed assessment roll is on file for public inspection at the City Clerk’s office. The total amount of the proposed assessment for the project is $1,128,519. Written or oral objections will be considered at this hearing. A reasonable estimate of the impact of the assessment will be available at the hearing. 

PREPAYMENT. Property owners may, at any time prior to certification of the assessments to the County Auditor as of November 15, 2019, pay the entire assessment to the City of Oakdale. (Interest, at a rate not to exceed 4%, shall be charged after October 15, 2019). Property owners may, at any time thereafter, pay to the City of Oakdale the entire amount of the assessment remaining unpaid. Such payment must be made before November 15 or interest will be charged through December 31 of the succeeding year. The first of the ten installments will be payable with the general taxes collectible in 2020. Interest shall be added to each subsequent installment when due for one year on all unpaid installments. Property owners have the right to partially prepay assessments consistent with Chapter 2, Article VII of the Code of Ordinances. If property owners decide not to prepay assessment before the date stated above, the proposed assessment will be levied consistent with the interest rate and installment information provided to each property owner. 

APPEALS. Appeals must be in the form of a signed, written objection filed with the clerk prior to the hearing or presented to the presiding officer at the hearing. The City Council may upon such notice consider any objection to the amount of a proposed individual assessment at an adjourned meeting upon such further notice to the affected property owners. An owner who has submitted a written objection may appeal an assessment to District Court pursuant to Minnesota Statutes Section 429.081 by serving notice of the appeal upon the Mayor or Clerk of the City within 30 days after the adoption of the assessment and filing such notice with the District Court within ten days after service upon the Mayor or Clerk.

PUBLIC NOTICE 

The Ramsey County Public Works Department hereby gives public notice of its intent to aerate certain County lakes to prevent winterkill of fish. Aeration systems create open water and thin ice. Stay clear of marked areas! The County intends to use both permanent and mobile systems, which will be operated between November 19, 2018 and April 26, 2019, as needed. Mobile systems will be used at Como, Otter, Beaver, Loeb, and Pickerel lakes. Permanent systems will be used at 

Island, Owasso, and Silver Lake in North St. Paul. The Department of Natural Resources has issued permits to the Ramsey County Department of Public Works to do this work.

THAT the December 18, 2018 reflection study session which begins at 5:00 p.m. in Conference Room 202 of the District Education Center include the following agenda items: 1)Ice Breaker; 2)Board Committees; 3)Board Officer Succession; and 4)Reports.

THAT a special meeting be set for January 15, 2019, in the board room of the District Education Center with a start time of 4:30 p.m. and the following agenda items: 1)Oath of Office; 2)Election of Officers; and 3)Organizational Resolutions. 

Yener asked board members to set the time, agenda and location for the January 15, 2019 work study session. Livingston moved and neve seconded the following motion, which carried on a 7 – 0 vote: 

THAT the January 15, 2019 work study session begin immediately following the adjournment of the January 15, 2019 special meeting (approximate start time of 4:45 p.m.) in Conference Room 202 of the District Education Center and include the following agenda items: 1)Superintendent Check In; 2)Facilities; 3)2019-2020 Enrollment & Financial Projections. 

Coborn moved and Anderson seconded the following motion, which carried: 

THAT the meeting be adjourned.

NOTICE OF HEARING

ON PROPOSED IMPROVEMENT 

Notice is hereby given that the city council of Lauderdale, Minnesota will meet in the council chambers of the city hall at 7:30 p.m. on January 8, 2019, to consider the making of the 2019 Infrastructure Improvement Project, an improvement to Eustis Street between Larpenteur Avenue (CSAH 30) and Roselawn Avenue and Roselawn Avenue between the TH280 right-of-way and Fulham Street. The improvement includes the reconstruction of Eustis Street and the rehabilitation of Roselawn Avenue including utility improvements pursuant to Minn. Stat. §§ 429.011 to 429.111. The estimated cost of the improvement is $2,459,830. The City Council intends to assess a portion of the costs against the abutting property owners on those streets. A reasonable estimate of the impact of the assessment will be available at the hearing. Such persons as desire to be heard with reference to the proposed improvement will be heard at this meeting.

Notice is hereby given that the New Brighton Planning Commission will hold a public hearing on the following land use item(s) on January 15, 2019 at 7:00 PM in the Council Chambers at New Brighton City Hall. 

1. Special Use Permits and Variances: Request from Mounds View Public Schools to amend an existing Special Use Permit in order to complete additions and upgrades to Irondale High School located at 2425 Long Lake Road. Variances are requested to building height for a new auditorium, parking spaces, and required parking setbacks – PID 17-30-23-22-0043. 

2. Rezoning: Adoption of an ordinance rezoning property located at 2770 and 2750 I-694 Service Drive from B-1 to R-3B (PIDs 19-30-23-34-0008 & 19-30-23-345-0009) in conformance with the City’s new 2040 Comprehensive Plan. This area, known as the Benedictine Health Center campus, is guided for “Mixed Use Regional” development by the new Comprehensive Plan, and the proposed rezoning would allow for consideration of a Planned Residential Development in compliance with the new Comprehensive Plan. 

3. Rezoning: Adoption of an ordinance rezoning property located in the New Brighton Interchange (known as the old New Brighton Elementary School and surrounding lands – specifically PIDs 29-30-23-13-0021, 29-30-23-13-0020, 29-30-23-13-0022, 29-30-23-13-0023, 29-30-23-13-0025, and 29-30-23-13-0024) from R-1 and B-3 to R-3B in conformance with the City’s new 2040 Comprehensive Plan. The area is guided for “Mixed Use Neighborhood” development by the new Comprehensive Plan, and the proposed rezoning would allow for consideration of a Planned Residential Development in compliance with the new Comprehensive Plan. 

4. Preliminary Planned Residential Development: Application from the Benedictine Health Center to add new independent living (56 units), assisted living (40 units), and assisted living memory care (24 units) to the existing facility at 1101 Black Oak Drive in compliance with the 2040 comprehensive plan – PIDs 19-30-23-34-0051, 19-30-23-34-0008, & 19-30-23-345-0009.
